5 out of 5 stars An excellent companion to your case book.......2006-12-20

This book does an excellent job at laying out the default rules and explaining them in an organized manner. What is even better about the book is its use of charts to demonstrate the differences between the various default statutes. This book definitely helped me earn a goo grade in the class. I highly recommend it. For anyone who has taken a course with Professor Kleinberger, this book is written much differently than his lecturing style, and it will help make sense of what is covered in class.

4 out of 5 stars Nice and Simple.......2004-10-31

This book was nice and simple. A good summary of what you need to know. The section on agency was great. I think he got a little carried away in the partnerships section when he compared RUPA and UPA. I would definitely recommend this book to anyone who wants a comprehensive summary of the law of agency, partnerships, and unincorporated entities.

Customer Reviews:

4 out of 5 stars Why does the index have to be so lousy for law books?.......2006-02-28

First off, I have found the Gilbert commercial law school outlines to be the best. They also put out the best lectures on tape/CD.

However, the index is nearly as bad as Emanuel's. You can't just look up a subject by a word, such as "minors." For instance, if I can't remember whether or not a minor can be an agent, I can't just go to "M" in the index for "minor." I have to try and figure out which category or chapter the authors would have included that information in, and then hope they actually at least put "minor" in the index under the mystery section.

These guys expect us to remember that the issue regarding a minor is "capacity," then figure out that "capacity" would be under "creating agencies," for example--which of course is a huge pain when you're exhausted with studying law & your brain is too wiped out to have to go through all that just to look up whether or not a minor can become an agent...

That said, when you do finally find the section you're looking for....the outline is written pretty clearly & concisely without giving you all of the previous laws that are no longer relevent, like the Emanuel outlines do, which drives me nuts, too.

Before you begin with this outline, though, I suggest you buy yourself a bunch of tab post-its so you can find info easily again, or jot your own index inside the front cover as you go along. Better yet, keep a running outline/notes document on your computer so you can just do a search of your document to quickly find topics/rules without having to spend 1/2 hour trying to figure out where it was in the Gilbert outline again.

5 out of 5 stars Best Gilberts I Own .......2005-11-07

The is the standard Gilberts outline book. A little thinner than most, but the content is good. If your professor is extremely socratic like mine was, this is the book for you. Even if the cases don't all match, the ideas are framed in easy to understand outline format. I know people who have kept this book and used it for bar review after graduation from law school!

Book Description

This set of CDs includes a 3 hour lecture on Agency and Partnership and a 9 page handout.

For the Law School Legends Audio Series, we found the truly gifted law school professors most law students can only dream about - the professors who draw rave reviews not only for their scholarship, but for their ability to make the law easy to understand. We asked these select few professors to condense their courses into a single lecture. And it's these lectures you'll find in the Law School Legends Audio Series. With Law School Legends, you'll get a brilliant law professor explaining an entire subject to you in one simple, dynamic lecture.

Customer Reviews:

5 out of 5 stars This guy is HALARIOUS!.......2007-01-14

Just his inflection makes this lecture so funny you will likely have to stop listening from time to time to get yourself together (he doesn't really tell jokes, but the way he speaks is just plain halarious)! I am a 3L who uses tapes/cds for every class I can find them, and this by far was the funniest one. He also, of course, does a great job of breaking down, organizing, and providing examples to put agency and partnership into bite size pieces to make it very easy to understand and remember. I was happy with the grade I got on my final (I relied on the cds to make my outline).

4 out of 5 stars Great professor with easy listening style........2006-02-28

Another great lecture from Gilbert's Law School Legends Series. The California bar exam will include agency, partnership, limited liabiity companies, etc., starting in 2007, I believe. At any rate, I will have to know it when I take the bar, and so my online law school is requiring it in 2L now, which I'm in. I transcribed this entire lecture & use it to study with.

This lecture simplifies this subject. Toss that evil case book if you can, which is horrendously dry & complicated, transcribe this lecture & you'll be sitting pretty. Professor Evans is well-spoken & easy to listen to, as he speaks mainly in real english as opposed to legalese. Buy this one instead of the Professor Munch Sum & Substance tapes, if you have the choice, which is painful to listen to.

I prefer to use the cassettes because it's so much easier to just rewind a few words, as opposed to CD's & they're usually much cheaper, too.

Book Description

Savas provides a complete guide to privatization--the background, theory, and practical reality. This book explains what, why, when, and how to privatize. Contracting services, using franchises and vouchers, divesting government-owned businesses, privatizing infrastructure through public-private partnerships, reforming education, privatizing the welfare state, and overcoming opposition to privatization are discussed in detail. In addition, Savas provides hundreds of examples from local, state, and federal government in the U.S. and other countries.

Customer Reviews:

5 out of 5 stars media wants to burn this and suppress it.......2002-03-01

Is awesome to see ideas outside the mainstream. Most people today like monarchy. Kings are obsolete. Let people do as they please and the inefficiency will be squirted free like bad zits. Rmoving the rules that govern is privatization. Privatizing education alone would lead to much smarter people. Let all the rules that restrain people from creating good go away. Watch life improve. think different. Think freedom of action from the rules of the king.

5 out of 5 stars awesome book anti-rules--media will want to burn it.......2002-03-01

Being a real rebel is thinking different. Thats what this author does. Get rid of rules of the goverment. Let private owners decide. These ways of releasing people lead to hugely improved results. Awesome read. Media will want to burn this book. It explodes all collectivist works.

2 out of 5 stars Pro-Privatization.......2000-06-06

I will begin by stating that I have a major problem with the book. Savas skews his own statistics in order to push readers into supporting the privatization of our nation's public sector. His book focuses entirely on the private sector's greater efficiency over the public sector without addressing many other important issues. If you want a very one sided book that is pro-privatization, then buy this one. If, however, you would like a book that seeks to enlighten readers with facts and allows them to make their own decision on the matter, then find another book.

    Product Description

In addition to its coverage of agency and partnership, the new edition of Agency and Partnership Law adds coverage of limited liability partnerships and limited liability companies. Because the authors feel that agency law is the foundation on which the law of business firms is built, the second edition retains substantial treatment of both the contract and tort aspects of agency law. Rosin and Closen integrate problems into the text to facilitate teaching by the problem method and introduces a transactional perspective by using problems that ask students to structure transactions so as to achieve client goals while addressing the concerns raised in the materials. The new edition also continues to cover the various unincorporated firms by comparing and contrasting their functional characteristics.

    Product Description

High Court Case Summaries on Business Associations, keyed to Klein's Casebook on Business Associations 5th edition. Contains well-prepared briefs for each major case in Klein's casebook on business associations, 5th ed. High Court briefs are written to present the essential facts, issue, decision and rationale for each case in a clear, concise manner. While prepared briefs can never substitute for the insight gained by actually reading a case, these briefs will help readers to identify, understand, and absorb the core “take away” knowledge from each case. Moreover, these briefs are followed by a useful legal analysis, which provides extra tips and contextual background about each case, connecting the case to the broader concepts being developed throughout the casebook. This book also supplies case vocabulary, which defines new or unusual legal words found throughout the cases. Finally, to enhance the reader's recall, there is a corresponding memory graphic for each brief that portrays an entertaining visual representation of the relevant facts or law of the case.

    Customer Reviews:

    4 out of 5 stars Great Synopsis.......2007-07-24

It provides the usual memorable cartoons, useful summaries, and thoughtful commentary. Unlike some of the others, like Constitutional Law, I would not rely on the Summaries alone though - there is far too much stuff in the afternotes that obviously cannot be analyzed by the book alone.

But if you like HCCS, I recommend it highly. Its an excellent introduction, and helps you cut through much of the legal verbiage to hone in on what you need to know.

      Book Description

As government faces more complex problems, and citizens expect more, the way government delivers services and results is changing rapidly. The traditional model of government agencies administering hundreds of programs by themselves is giving way to one-stop services and cross-agency results. This translation implies collaboration--within agencies; among agencies; among levels of governments; and among the public, private, and nonprofit sectors. The first part of this book describes what networks and partnerships are. The second part presents case examples of how collaborative approaches have actually worked in the public sector, when they should be used, and what it takes to manage and coordinate them.

        Book Description

This text describes and explains the law of agency, partnership, the limited liability company (LLC), and other unincorporated business enterprises. Included is discussion regarding the adoption of the check-the-box regulations by the Internal Revenue Service, which resulted in changes to the uniform acts and state legislation for partnerships and the LLC. This nutshell also updates all of the other substantive changes in these highly important areas of the law. In addition, many of the chapters from the First Edition have been rewritten and expanded, with the goal of providing a useful and relatively complete study aid for the student reader.

        Product Description

Continuing the tradition that has made it a leader in its field, Problems on Professional Responsibility uses problems to provide an overview of lawyers' professional responsibility. One of the most rapidly changing fields in American law, professional responsibility sees new issues, rules and cases each year, all of which are covered in this book. The Ninth Edition covers the American Bar Association's Model Rules of Professional Conduct, which were extensively rewritten in 2002; the American Law Institute's Restatement Third, The Law Governing Lawyers, and issues raised by federal agencies that play an important role in determining lawyer standards. Other changes to this edition include more citing authorities, fewer black letter questions and issues in each problem to allow more time for discussion and questions; and the integration of readings into discussion materials.

2 out of 5 stars Not so hot overview of Agency & Corp Law.......2005-12-17

I was unimpressed with this book. Many in my class struggled because of the way the book was thrown together.
My main problems are the lack of explanation for key concepts, other than a reference to a cut-down case and the questionable decision to use cases that don't clearly explain the issue at hand.
I was thrown off at first when I couldn't find some of the cases in Lexis or WestLaw. Rather than relying on an on-topic US SC case or even a Fed circuit case, some key concepts get examples that are unpublished lower-court decisions where the judge makes either the wrong decision or the right decision for the wrong rulings. The book does not point out the error of the court when it does this. Most of the time this happened, my professor would point out that we should ignore this case and learn the concept from a study guide or his class notes. In an ideal BA book, the authors wouldn't try to trick students by giving them bad examples of the law (or without explaining that the examples have faulty legal logic).
If you are reading this review, you are likely either a law student or a law professor. If you are a professor, please think twice about using this book. If you are a student, you will have no choice in the matter. If you find yourself struggling then read the Lexis and Westlaw briefs or get the High Court Summary for this book. My school bookstore didn't have the HC summaries for this book, but Amazon did.

        Customer Reviews:

5 out of 5 stars Excellent, concise guidebook.......2006-02-12

This book really helped in BizOrgs. Much better written than the average legal text, concise, and well-organized. Bainbridge's treatise on Corporations is great, too. This continues the tradition of excellent Concepts & Insights handbooks (Chirelstein on Contracts is a must).
