This covers a really wide range of subjects that pretty much every manager, supervisor or HR Rep would have to deal with at some time or another and it explains complicated issues in easy to understand language. I really like the style of this book: For every question it has a brief answer or summary that gets to the point and then has a "Tell me more" section that breaks things down in more detail (but still easy to understand). Plus it gives samples of any kind of letter, documentation, appraisal you would have to administer. I read this book cover to cover, there wasn't anything I skipped over because pretty much every question & answer was useful.

I'm opening a small business and need information on hiring and managing employees. After reading this book, my knowledge of hiring employees hasn't changed much. This books focuses on the legal issues and paperwork required when dealing with employees. If you are looking for insight on how to hire good workers and how to interview people, find another book.

Whether you're a human resources professional or an executive or manager in a company without a human resources department, you are confronted by all sorts of difficult personnel questions. Hiring and firing can be highly complicated subjects. Scary. Unless you have someone you can turn to for reliable advice.

Never fear. Paul Falcone is here! The author of "96 Great Interview Questions to Ask Before You Hire" and "101 Sample Write-Ups for Documenting Employee Performance Problems" has authored a book that will relieve the stress in your people-management life. Falcone is Director of Employment and Development Paramount Pictures in Hollywood and teaches for UCLA. Here's a resource who knows what he's talking about.

This book is organized into two main sections: Hiring and Firing. Under the Hiring Section, you'll find chapters on the hiring process, recruitment tools, online recruiting, interviewing, and making the final selection. The Firing Section begins with a chapter answering common questions about the performance management and termination process. Next, the reader will learn about progressive discipline, terminations for cause and summary offenses, and reductions-in-force and layoffs.

This book was not bad, but left me wanting a few more answers. It's a nice introduction to the nanny hiring process, if you are completely new to the idea of paid childcare. The style is easy to read, and much of it is written in a Q&A format (like the What to Expect books you read when you were pregnant). There were at least a few areas that I thought were too thin, however. I could have used more guidance on interview questions and questions to ask a reference. I could have also used a little more guidance on payroll taxes, FICA, etc. I had to turn to other sources for that kind of information. It was fairly readily available, and I think it should have been included in the book.

We had just started our nanny search when I stumbled upon this book. I'm glad I read it before we got any further into the search. As much as I knew a nanny was the right childcare option for us, the whole process was overwhelming to me. I feel armed with so much more insight and confidence now. It's a must-read if you're thinking of going the nanny route. I found it VERY easy to read and I really enjoyed the structure and tone.

Look, I feel sincerely sorry for families who wind up with nannies from the dark side, as profiled in this book. But some of the advice doesn't take the nanny's POV into consideration at all. For example, if, as the author describes, your child bites her nanny hard enough to leave a bruise, and the nanny jokes about spanking the child, STOP being so shocked that the nanny would JOKE about such a thing and listen to what she's really saying, which is, How do you want me to discipline your child? Because I do NOT deserve to be bitten. Trust me, I've been there when Mommy says, "Aw, that's my rambunctious little guy!" right after I've gotten through explaining that my glasses are NOT a toy to be pulled off my face....

I saw this book in an article in the New York Times a few weeks ago...at just the same time I was hiring yet another new nanny. I love this book. The advice is straightforward and there are all kinds of great stories from both parents and nannies about how to get along. The chapters on hiring, salary needs, time off (do you pay for President's Day?), and sorting out the household chores have all come in handy. If you are thinking of making a change--or are hiring for the first time--I highly recommend this book. We've bought our new nanny a copy too!

I really enjoyed the no-nonsense approach that the authors took in this book--particularly their willingness to focus on things that can go wrong in a relationship. Not all nanny-parent relationships are made in heaven!

While I enjoyed the chatty style, the book was sometimes a little lacking in specifics. That's why I recommend that parents also consider picking up a copy of The Unofficial Guide to Childcare--a fabulous book that covers the do's and don'ts of hiring a nanny in considerable detail and that boasts the best nanny contract I've ever found anywhere. Armed with these two terrific books, a parent can't go wrong.

This is the Fourth Edition of an exceptionally valuable book which was first published in 1991. Weiss has updated his material to accommodate new laws, regulations, and court decisions which are directly relevant to discrimination and EEOC guidelines, employee verification and security, technology issues, sexual harassment, negligent hiring practices, management of people with disabilities, affirmative action, discipline and termination policies and procedures, defamation, violations of privacy, the Family and Medical Leave Act, evaluations and promotions, sex and age discrimination, and labor law.

As is also true of previous editions, the subtitle correctly indicates that Weiss explains "safe hiring, managing & firing practices to keep you & your company out of court." He organizes the material as follows:

Part I Safe Hiring Practices [re recruiting, interviewing, and employment decisions]

Part II Safe Management Practices [re evaluations and promotions, preventing sex discrimination and sexual harassment on the job, employee action laws and labor rights]

Part III Safe Firing Practices [re discipline and firing practices, public policy, management of older employees]

With Weiss's guidance, it is possible for the decision-makers in any company to complete what amounts to a comprehensive "audit" of any and all areas in which that company could be vulnerable to litigation. Of at least equal importance, the same "audit" will help the company to determine precisely what its obligations are as an employer as well as what the legal rights of each employees are.

Perhaps it would be helpful to those who read this commentary if I now provide a brief excerpt which is representative of the quality of Weiss?s counsel throughout the entire book. I have deliberately selected an especially troublesome area, one which has been the focal point of countless lawsuits: Employee Performance Evaluation. According to Weiss: ?Subjective rating systems in themselves are not illegal. The EEOC and the courts recognize subjective job standards such as communication and leadership skills) and that the words [in italics] good, satisfactory, poor, and unsatisfactory [end italics] carry within them subjective elements. So where do they draw the line?

1. When standards are unequally applied or do not exist at all; and

2. When someone shows that the standards or their absence produces disparate treatment in promotion and compensation policies, as for example:

? When sex stereotyping tainted the process by which a woman was denied a partnership in a [major] accounting firm or

? When subjective decision making torpedoed promotion policies that have disparate impact on minorities.

EEOC and court rulings encourage objective performance appraisals, but they discourage using them as a subterfuge for discrimination.?

Weiss devotes all of Chapter 6 to explaining HOW to formulate policies and procedures so that all evaluations and promotions are ?safe.? That is, they are in full compliance with all applicable regulatory laws, rules, and regulations.

Throughout this brilliant book, as Weiss rigorously and thoroughly examines hiring, managing, and firing practices which are both ethical and legal, he explains What You Can Do and What You Cannot Do. However, with all due respect to Weiss, qualified legal counsel should be consulted to ensure that all of a company's policies and procedures are "fair, square & legal." One of the many value-added benefits of this updated edition is that Weiss identifies a number of ?Cases? at the end of each chapter to which his readers and their legal counsel are referred. There are 17 cited at the end of Chapter 6.

An organization?s policies and procedures concerning employment law must then be carefully explained to all of its employees as well as contained within an employee manual. If at all possible, the same policies and procedures should be readily available online. Of course, they must be rigorously and consistently enforced. Even so, there may yet be frivolous lawsuits but at least the company has done everything possible to prevent them and is thus much better prepared to obtain a favorable decision in a court of law if and when involved in litigation.

For small-to-midsize companies competing in a litigious society, this book is more than a "must read": it is an absolutely essential source of information to which decision-makers (especially owners) of such companies should constantly refer. The term "frivolous lawsuit" is really a misnomer. Check a reputable dictionary of synonyms and you will learn that the word frivolous connotes "trivial, trifling, piddling, unimportant, insignificant, inconsiderable, petty, and paltry." On the contrary, an adverse decision resulting from a so-called frivolous lawsuit can destroy a company which has limited resources...or at least create truly serious problems for it, most of which are preventable.

The subtitle of Weiss's book correctly indicates that he explains "safe hiring, managing & firing practices to keep you & your company out of court." He organizes the material as follows:

Part I Safe Hiring Practices [re recruiting, interviewing, and employment decisions]

      The content and reviews that I read for this book far exceed what I gained from reading it. It doesn't have a review that was helpful in making any decisions about discrimination more than any basic textbook would. I could not in good conscience recommend this book to anyone.
