Book Description

The Fourth Edition offers a comprehensive treatment of the entire subject of personnel law that reflects the author's personal experience as both a practicing lawyer and personnel director. Written in simple language that bridges the gap between law and human relations management, the new edition explores the legal considerations that occur when an employer-employee relationship is established, and focuses on permissible activities in handling personnel problems, when to seek legal counsel, and how to stay out of court. Offers new case law where the legal principles have been changed by the courts. Covers all the new statutes. Continues to find an economical way for the Epersonnel function to live with its law partner, <70> whose principles are laid down by legislation and interpreted by the courts. An excellent resource for those in the personnel/ human resources field.

Customer Reviews:

1 out of 5 stars do NOT use this as a textbook.......2002-11-06

The very first sentence of the Prologue of this book contains a grammatical error (it should be "principles," not "principals") and I am sorry to say that things don't get much better. I purchased this book as a text for an Employment Law class and it was terrible; I quit using it halfway through the course and recommended the instructor find another text. The author seems to think he's the most credible person in the world but, as someone who is also a human resources practitioner, I can assert from experience that many of his opinions (several of which are presented as "facts") are wrong. He clearly doesn't even understand what the field of human resources IS, and in many cases I found his tone very offensive.

In addition to using more current information, Sovereign would be well-advised to better consider his audience and to research the field of human resources in general. I would suggest he start with professional organizations such as SHRM or ASTD; the advice and information on their web sites is far superior to anything in this text.

1 out of 5 stars Hodgepodge of mismatched topics.......2000-06-30

Sovereign seems to skip around often in a half-hearted effort at being comprehensive. The cases are not very recent, despite the publication date, and the book has a definite lack of flow. It is almost as if the author threw together several mismatched segments and forgot to edit it for comprehension and cohesiveness.

3 out of 5 stars Adequate on the law; suffers from poor editing.......1998-02-27

I have to use this book as the text for a class I teach in Employment Law (i.e., non-collective-bargaining law) to students matriculating to a Master of Science Degree in Human Resources. The text adequately surveys the law, but suffers from terrible proofing and editing; it also needs an update, because the 1994 edition obviously was not written any later than early 1993, based on the omission of certain important U.S. Supreme Court cases from 1994 and since. The book also suffers from an extremely strong pro-management tone; a more balanced approach would serve the untutored reader better. There are better books, such as the ABA Guide, which I commend to potential readers of this book.

2 out of 5 stars Not very good, but the only thing out there.......2006-05-04

This book, like most of the other nutshells I've read, is not particularly helpful. The organization is confusing, and not enough attention is devoted to major topics, as the format is primarily just a recitation of cases. A study guide is supposed to provide a concise synopsis of the law, not merely throw a bunch of conflicting cases at the reader. Steven Emanuel has the market for law school study aides cornered, with the Examples & Explanations series a distant second. Unfortunately, this is the only major study guide that exists for employment law. Thanks to Rothstein's worthless and maddening casebook, learning employment law is neither interesting nor fun. This nutshell will provide some relief, but not much.

5 out of 5 stars Different viewpoints.......2005-04-01

There was once a boss and an employee. They both saw things from a different viewpoint and from the vision of their own eyes both were entitled to their own opinions and neither was to blame for the differing viewpoints.

Customer Reviews:

5 out of 5 stars Good book to help you negotiate the slippery slope.......2001-02-07

Author Tobias guides the reader through that awful experience of losing a job. Employees sometimes need to know what there rights are, and this book helps. Useful for me as I negotiated severance and letters of recommendation...something that my employer really didn't want to do.

5 out of 5 stars A Very Informative Book.......2000-01-05

This book is excellent. A great help for those who have recently been fired from a job or who are expecting to get the axe. I especially felt that the chapters on negotiating a separation package were useful.

5 out of 5 stars This is an excellent guide for workers' rights........1999-11-09

I would recommend this book to anyone who is having problems at work

4 out of 5 stars 101 Strategies for Recruiting Success.......2007-07-18

It's an extremely scary thought but many Human Resource professionals aren't even trained in HR. They are simply people whose jobs have been downsized and the company had no where else to put them. How can these people possibly find the right people for the right job?

101 Strategies for Recruiting Success is a one of a kind resource that provides a solution for recruiting woos. The book is packed full of very specific ways to find qualified potential employees and how to match these individuals to their dream job. These strategies are presented in a very intuitive fashion to help the beginner learn the basics and build from there. The invaluable material contained in these sections is presented in a clear and meticulous way that can easily be integrated into real business hiring decisions.

3 out of 5 stars Not impressed.......2007-06-24

The information on this book is very basic. It may be useful to a college grad looking to get a start in recruiting or to entry level employees. Some of the information in this book is common sense. If you have been recruiting for a few years, this not the book for you.

5 out of 5 stars An Invaluable Resource That Got Me Started In The Biz..........2007-04-07

I could not disagree more with the short and pointless critique above. This book covers many facets of the business and is incredibly helpful both to rookie headhunters in the trenches (like myself) as well as to corporate HR departments. It's a double edged sword of course because the more corporate HR leaders read this and follow it's wisdom, the less they will need headhunters like myself but that's because it is excellent advice and you can't fault that. The individual who made the snarky remark above about planning your day and not liking the general advice that this book offers needs to understand that recruiters are their own bosses and the way to run your desk is to plan out each day to a T and to understand how to prioritize based on what your employers needs are as well as your own. It's not that complicated but is incredibly important!

In short, someone who takes the time to read the book and apply it's teachings will find themselves as I did in a position to find the right people everytime through creativity, perseverance and true honest to goodness work (rather than relying on the job boards and other "low-hanging fruit" that keeps corporate america forever looking for trained individuals like myself to find the people they need).

Good luck to all my peers out there and take the time to study this book!!

1 out of 5 stars A view from 50,000 feet.......2007-03-15

If you are looking for a how-to book with tricks and tips of the trade, this is not the book for you. ie., "Strategy 97- Plan Your Day" ... We all know we need to plan our day; however, if the book attempted to explain how to effectively plan a recruiter's day, there would be some benefit to that! Mostly general advice is provided.

A powerful new technique for exposing the person behind the resume

Traditional interview techniques are notoriously inadequate when it comes to providing a picture of how a candidate will actually perform on the job. Recently, an interview style proven to more accurately identify the cream of the crop has been making headlines. It's called behavioral interviewing, and it involves getting candidates to truthfully describe how they responded to past job situations to indicate how well they will handle tasks required in their new position.

Coauthored by a hiring consultant to Coca-Cola, Nortel, Siemens, and other Fortune 500 companies, How to Choose the Right Person for the Right Job Every Time explains the advantages of behavioral interviewing and shows managers how to:

Of interest to anyone who wishes to understand more about employee rights and the revolutionizing of employment models, Employment and Employee Rights addresses the issue of rights in the workplace from the perspective of both employees and employers. In the process of exploring arguments for guaranteeing rights, the book examines the relational, developmental, and economic bases upon which they are founded. New dimensions of employment are also considered, including a model that incorporates growing workplace diversity, builds upon our understanding of the legal landscape, and expands upon our justifications for recognizing and protecting rights.Employment and Employee Rights defends employee rights as economic value added for employers and companies, and it suggests a model where employees engage in meaningful work, maintain their autonomy, and exercise a level of control over their employment.

            Book Description

According to author Glenn Solomon, the "at-will" employment rule has undermined economic security and basic civil rights for decades. In this book he exposes it for what it is and tells workers how to maximize their job protection. The rule essentially is that anyone can be fired at any time, with or without warning, for any reason not specifically prohibited by law (such as race). Moreover, it is extremely difficult to prove wrongful termination in court. Solomon discusses exceptions to the rule (government and union workers) and dispels popular myths about employee rights (many people believe they can only be fired for just cause). Although it deals with sometimes complex legal concepts, the book is written in a style accessible to the average reader. Real-life cases illustrate the author's points throughout. Important topics include contracts, discrimination, deciding whether or not to sue, and setting a damage amount. Solomon concludes with a proposal for a "workplace without fear" and replaces the at-will rule with a for-cause standard for terminating employment.

5 out of 5 stars Lawyer coaches workers on real life work problems.......2006-03-09

There are several aspects to this review that I would like to cover.

First, the author seems very credible, with decades of valuable
experience, with real-life situations that he's gone through,
and this is what people need more and more, versus ivory tower,
university textbooks from PhD professors who are out of touch.

Second, perhaps this book will be helpful with the author's
consulting profession, as I would guess that a large amount of
his unbillable, hours wasted was spent explaining the a-b-c's
to the average American worker, who would ring him up, or visit
his office about a labor conflict. This book, I would imagine,
will help greatly the average person in sizing up what can and
cannot be done in legal terms about that work conflict.

Third, the author clearly is more Democrat leaning ideologically
speaking, so it's no surprise that this book is for workers,
and NOT for bosses, or HR Managers or even to kiss up to those
people looking to overpower and maintain tight control over
            laborers.

Fourth, it's written in a layman's manner, understandable, and
not disnecessarily or overly complicated, which is the right
way to present the facts - which themselves, are introductory
            but essential.

Overall, this is an interesting book for people who don't have
any ideas how the workplace and workers' rights relate to
laws as they apply to workers and employees.

e.g. I hired an employment specialized attorney 2 years ago,
and when I finished reading this book, I began thinking that
the lawyer I had hired was absolutely clueless in matters of
law, and was merely trained in procedural events.

5 out of 5 stars Read This Book.......2004-04-08

You Could Be Fired for Reading This Book is an important book for anyone with a job. The fact that most workers are employed "at-will" (at the will of the employer) and, therefore, disturbingly vulnerable to losing their jobs is crucial information and not very well known. Author Glenn Solomon explains this basic employment reality -- and how we got there -- and presents ways to combat it, both on the job and if one is fired. With engaging style and wit, Solomon brings his legal expertise to an important subject whose time has come.
As Solomon guides the reader through the reality of being an "at-will" employee, he dispels often-held myths of employment protection and gives guidelines for genuine empowerment. There are things that can be done to make one's job more secure, as well as pitfalls to avoid. And should one lose one's job unfairly (all too common in the "at-will" universe), Solomon gives a step-by-step description of the processes involved in filing a claim. You Could Be Fired for Reading this Book is both an interesting eye-opener and an important resource to have on hand.
