The very important balance of public and private interests is present all over this great book, that can be an insightful introduction to International Investment Law, as well as a guide to more experienced practicioners and jurists.
The appropriate sensitivity towards developing countries needs and limits and investors justified concerns as well, drives the reader throughout the most important agreements and institutes and defines the book as a fundamental reading to everybody who is interested in International Law of Foreign Investment.

Arbitration of overseas investment disputes is one of the fastest growing areas of international dispute resolution. The exponential growth of international investment in recent years has led to the signature of over two thousand Bilateral Investment Treaties (BITs) between foreign states, in addition to a wealth of multilateral treaties and other forms of concession agreements. Disputes that have arisen are often resolved through the forum of international arbitration, and typically involve claims by an investor company for compensation when an investment has been illegally expropriated or adversely affected by the state's activities. The legal principles that have developed in this area are subject to intense debate, and are still in a state of flux. While tribunals routinely state that they are applying principles of public international law to determine disputes, many of the principles applied have only been developed recently in the context of investment treaty arbitrations, and tribunals are often guided more by the approaches taken by other tribunals, than by pre-existing doctrines of public international law. However, the volume of law created, applied and analysed by tribunals is such that it is now possible to begin the necessary process of codification. International Investment Arbitration:Substantive Principles is an important step in this process. The book provides a detailed analytical survey of the developing substantive principles which are being applied to disputes by international investment tribunals. It considers the key questions that arise, and provides a clear description of the present state of the law as reflected in tribunal practice. Best book ever written.......2007-09-14
This was the most thoroughly informative, entertaining, and magnificent piece of literature I have ever read on any subject. Richard Doernberg sheds light on some of the most difficult concepts in U.S. tax law. His clever insights and piercing intellectual observations will make you reconsider your thoughts on life, the universe, and everything. Doernberg is truly the best thing to happen to international taxation since the check the box regulations.

The International Tax Nutshell is a wonderful overview of international tax. As some comments have indicated, it is a tough area, but Doernberg does a great job of guiding people through the various twists and turns.

Disregard reviews criticizing the technical nature of this book. I became a fond user of the Nutshell series when I was in law school; I don't think that these books were ever intended for use by the Average Joe. By its very nature, the subject matter is technical and can only be simplified so much. There is a reason why there is no such book as "International Taxation for Dummies" or "Brain Surgery for Dummies".
These books are great to use as a springboard for further research and study of the issues covered. I would recommend the book to students and practitioners of accounting, business, and taxation.

It a good book in terms of what to spect from a "in a nut shell" book, but the topic is reeaaally boring.
Too technical for somebody just wanting to get an idea of this subject.

This would probably be a great book for a law student, but not for a lay person. I consider myself to be fairly intelligent, but I had a bit of difficulty wading through this to find the little bit of info that I needed. I'm sure it's also a great book for someone with a tax background.

The recent explosion of investment treaty arbitration marks a major transformation of both international and public law, above all because of the manner in which states have delegated core powers of the courts to private arbitrators. This book outlines investment treaty arbitration as a public law system and demonstrates how the system goes beyond all other forms of international adjudication in giving arbitrators a comprehensive jurisdiction to determine the legality of sovereign acts and to award public funds to businesses that sustain loss as a result of government regulation. The analysis also reveals some startling consequences of transplanting rules of commercial arbitration into the regulatory sphere. For instance, the system allows public law to be interpreted by arbitrators in private as a matter of course, with limited scope for judicial review. Further, arbitrators can award compensation to investors in ways that go beyond domestic systems of state liability, and these awards may then be enforced in as many as 165 countries, making them more widely enforceable than any other adjudicative decision in public law. The system's mixture of private arbitration and public law undermines accountability and openness in judicial decision-making. But, most importantly, it poses a unique and fundamental challenge - hitherto neglected by other commentators - to the principle of judicial independence. To address this, this book argues that the system be replaced with an international investment court, properly constituted according to public law principles, and made up of tenured judges.
