Book Description

Business has always been driven by ingenuity and innovation. Now, more than ever, with an economy built on "knowledge work" and intangible value, developing--and protecting--intellectual property is vital for individuals and organizations alike. This book presents a brief but thorough survey of U.S. patent law, presented in the clearest possible terms for nonspecialists--including scientists, engineers, business managers, and entrepreneurs--as well as students and practitioners of patent and intellectual property law. Drawing from both practical and academic experience, Alan Durham explains the basis of patent law and covers such topics as the application process, claim interpretation, the requirements of novelty and non-obviousness, disclosure requirements (such as "enablement" and "best mode"), and infringement--including infringement under the controversial "doctrine of equivalents." Complex legal issues are explained through in-depth examples, many borrowed from actual cases, and feature such timely topics as patent protection of computer software, business methods, and biological materials. This revised and updated edition discusses recent developments in the law and draws from the most current case authority. Used as an introduction to the topic or a handy desk reference, this book will be an indispensable guide to the dynamics and mechanics of patent law. Durham illustrates complex legal issues through dozens of in-depth examples, many borrowed from actual cases. Of particular interest are cases involving patent disputes over computer software, business practices, and biological materials. From building a better mousetrap to building a better mouse, Patent Law Essentials defines the coverage and limitations of patent law and its protections, and shows how they are applied in the courts and in practical application. This revised and updated edition discusses recent developments in the law and draws from the most current case authority. Used as an introduction to the topic or a handy desk reference, this book will be an indispensable guide to the dynamics and mechanics of patent law.

Customer Reviews:

5 out of 5 stars Good overview, but a little outdated.......2007-06-18

I read this, along with many other books from amazon on patent law, in order to prepare for the patent bar exam as inexpensively as possible. Well, as they say, you get what you pay for. I ended up not passing. I used OmniPrep to prepare the second time around, and passed with no problem.

5 out of 5 stars Essentially Great.......2007-01-03

By far the most useful and best written overview of patent law I have found. Very good as both an introduction for those new to the field and a review for those already involved. Good value for money.

5 out of 5 stars Perfect for the scientific professional.......2003-03-11

Perfect for the scientific professional or manager who must deal
with U.S. patents. Although technical throughout, I was never
lost or floundering. Well organized, well written, and just the
length and depth, I wish all technical books were of this
quality.

This book does NOT deal with corporate strategy for intellectual
property, nor does it get into much detail on how to write a
patent. There are, however, other books that directly address
these topics.

5 out of 5 stars An excellent warm-up for the real thing.......2002-08-24

While waiting to find out if my application to the PTO to sit for the next patent bar exam was approved, and prior to obtaining a full-fledged course of study on patent practice, I decided to invest in this book to get a better idea of what I was getting into. I must say that not only did I get a comprehensive introduction to the topic, but it was also an enjoyable read. The author uses subtle humor to get the points across, as exemplified by his use of various, patented mousetrap designs as examples, and his knowledge of patent law is superb. Indeed, there is hardly a page in the book sans footnotes and citations to case law.

Now that I am into the thick of learning the subject in detail in preparation for the exam, I find the subject matter familiar and that the overall perspective gained from Patent Law Essentials is invaluable.

This is a well organized, informative book that should be useful to any technical professional, especially, who wishes to demystify the arcane practice of patent prosecution.

5 out of 5 stars Concise and informative.......2002-03-12

This book gets to the point and is very well organized. The author apparently put a lot of thought into the flow of the book, making it very intuitive to follow. I've learned more from this small book, than I have from a book 5 times the size. The footnotes all throughout the book are excellent references as well (especially when studying for the patent exam). The author seems extremely knowledgable, and more importantly, does a great job relaying that knowlege onto the reader.

Satisfies the longstanding need for a practical, down-to-earth guide to intellectual property licensing

Intellectual property licensing is one of the most crucial, and least understood, income drivers among inventors and high-tech companies. Written by acknowledged experts in the field, Essentials of Intellectual Property Licensing provides managers with a clear, concise overview of IP licensing. In practical, down-to-earth language it clearly explains licensing strategies; deal making; royalties and royalty rates; patent, trademark and copyright licenses; and basic contract law. Managers learn the significance of intellectual property licensing on their bottom lines, and how to value both established and new intangible technologies. And, with the help of case studies and plenty of real-world tips and techniques for structuring and negotiating the best deals, the authors outline a complete step-by-step process for developing and implementing an effective intellectual property program in virtually any type of enterprise.

Paul J. Lerner (Suffern, NY) is Senior Vice President and General Counsel of General Patent Corporation, an intellectual property management company. Alexander I. Poltorak is the founder and Chief Executive Officer of General Patent Corporation.

5 out of 5 stars good read (considering the subject).......2007-07-18

This is a good guide for introducing someone to the subject. Like the title says, it's the essentials, giving the reader a foundation to come back to wherever the particulars of their situation might take them. It is a big plus that the book is surprisingly readable - Important given that the typical reader might have to read the book in order to develop an understanding of why they should have an interest in the subject.

Customer Reviews:

3 out of 5 stars Interesting but Flawed .......2006-06-06

The strength of this book is that it provides a comprehensible introduction to intellectual property - focusing on patents. If you want to learn something about intellectual property without wading too deep into lawyerspeak - this book may interest you. In addition to patents - trademarks, copyrights and trade secrets are discussed; other aspects of intellectual property are waved at. The last chapter provides dated coverage of intellectual property as it relates to the Internet - mostly focusing on business method patents. This is interesting from a business perspective but the authors do not seem versed in the technical aspects of E-Commerce. Laches and estoppel are demystified and the book presents what looks like solid advice on how to enforce your rights against a group of infringers (attack the weakest one first). There are clearly divided sections (making the frequent pauses that I occasionally made between readings convenient), key ideas are highlighted in an attractive manner and charts and graphs are well presented.

I'm not sure there is enough in depth information in this book to make it really useful. Just before the authors really dig into a subject they roll out their well-oiled marketing spiel - "consult a lawyer/professional on this issue". Patent law is even compared to brain surgery at one point. While consulting with a lawyer on serious patent litigation is probably good advice - it would have been nice if the authors had gone into more depth on the advice a lawyer might give. Throughout the book, patent law is treated as an impenetrable black box - the reader can get a look at the outside and hear a little about what goes on inside but opening the box entirely is expressly forbidden. I was repeatedly given the impressiion that the main purpose of this book was to serve to market the services of intellectual property attorneys and consultants to corporate executives.

Another flaw in the book is that the index is weak - which, along with the sparse table of contents and vague referrals to previous chapters - makes the book a poor reference. Another irritating blemish is that while the book presents a number of statistics, it includes no information on where they came from. Some sort of footnote referring to sources would have been nice.

Additional note (15 Jul): If you are at all interested in studying or learning about patents I highly recommend Patent it Yourself by David Pressman. I've only read the first few chapters but it's already clear that Patent it Yourself is ever so much more comprehensive, useful and practical than Essentials of Intellectual Property.

4 out of 5 stars A clear guide to IP.......2005-08-17

This book is both concise and complete in covering the major aspects of IP. Using language and examples that are easy to understand, I found this book to be a quick intro to the fast-growing world of IP. Highly recommended.

5 out of 5 stars Excellent Primer for the layman and seasoned professional!.......2003-11-12

This is an excellent book that I believe can help level the playing field for smaller companies vis-a-vis their larger competitors concerning exploiting the full value of
their intellectual property rights. The authors include a chapter addressed to corporate officers and directors concerning potential liability for mismanaging intellectual property. This chapter alone is an eye-opener that ought to be read by every director and officer not only to avoid liability but to enhance share value. The authors have given the reader a seminal work concerning the difficult nature of patent valuation including a method that uses the Black-Scholes option-pricing algorithm (since a patent's value, like an option, decreases with the passage of time, all other things being equal). The authors discuss the methods utilized to value a patent in a publicly traded company and point out that Eli Lilly lost $35 billion in market capitalization when one of its two Prozac patents was declared invalid for double-patenting, thus, demonstrating the enormous value of that patent. I am a patent attorney who learned much from this book. This is a highly readable and even entertaining book that makes an excellent primer for anyone interested in the business of intellectual property.

As a quick primer, I found this book to be terrific. And the dry humour was appreciated as well. Never thought I'd make it through so quickly, and yet come away with such a good appreciation of the subject matter.

    Book Description

While there are many books on "how to patent" and patent law, Essentials of Patents delivers practical advice on how to leverage patents as a powerful competitive corporate tool.

This is not your "ordinary patent book". It's emphasis is directed to patent management with the express emphasis of increasing shareholder value, and it's audience, each with its own chapter, includes the CEO / ICO, CFO, CTO, and cross functional managers of HR, Engineering, Manufacturing and IT. Essentials of Patents is arguably one of the first works on intellectual property that drives home the importance of patent creation, protection and exploitation throughout the enterprise.

Gibbs and DeMatteis show how patents can enhance competitive intelligence, product development cost reduction, product line expansion, and revenue streams, making this guide a must-have for the savvy manager.

In it, the authors introduce a new management methodology: Patent Quality Management, or "PQM". With public company market values more than 90% attributable to the value of intangible assets and patents, the time has come for all corporate managers, not just R&D and legal counsel, to master intellectual property management in this competitive global market (and shareholders are demanding it).

    Customer Reviews:

5 out of 5 stars Competia Online Magazine Review.......2003-06-26

Essentials of Patents is an insightful guide for business professionals who seek to have a better understanding of patents for strategic intelligence purposes. The book provides readers with the basics behind the nature of patents, the importance of patents when it comes to measuring corporate wealth, and a straightforward approach to establishing a Patent Quality Management (PQM) system.

The authors have broken down the content of the book into two distinct sections.

The first four chapters of the book are dedicated to the fundamentals of patents in the corporate world. Gibbs and DeMatteis discuss in detail the key aspects behind patent licensing, strategy, and tactics to make better business decisions.

The next six chapters focus on the management of patents within various departments in large companies. Readers are given examples of how patents can influence the way managers adjust their plans in marketing, engineering, manufacturing and operations. In addition, the authors share their views on how patents should be managed by finance, human resources and information technology departments.

The final two chapters discuss the role legal counsel and the CEO take on in a company that has a Patent Quality Management (PQM) system. After reading these chapters, readers will have a better idea of how critical the legal department and CEO are to managing existing and future patents.

Competitive intelligence practitioners who are not experts in the domain of patents, must read Essentials of Patents. When they are collecting information on patents, whether it is to track their competitors' new products or analyze the competitions' R&D abilities, they should keep book nearby.

A must read for those traditionally considered outside of the circle of patent management - IT, HR, Manufacturing, etc.

5 out of 5 stars Thank You DeMatteis and Gibbs...for Essentials..........2003-05-07

DeMatteis and Gibbs have so greatly contributed to the world of Invention and Patenting in such a multitude of ways and continue to do so by sharing their research, experience, knowledge and expertise with their readers in the brilliantly written and much needed "Essentials". This book is worth its weight in gold to say the very least. "Essentials" is virtually bursting with valuable money saving tips. I believe DeMatteis and Gibbs deserve more than a pat on the back for all of the knowledge they have spent years gathering through their own research, hard work and personal expericences and laying all of it right out on the table for the benefit of their readers.I have the highest respect for DeMatteis and Gibbs for yet another contribution to all of us .....for our benefit...this book is very precise and clearly written and is full of information involving the future, and the future is now!!! I am sure that many will join me in saying Thank you Gentleman, for yet another contribution and for making our lives easier.....I am already looking forward to your next book as are many others here in Northern California...

5 out of 5 stars The most comprehensive book on patents.......2003-04-25

The ESSENTIALS of PATENTS is the best book I have read on the subject. Andy and Bob have put together a book that really hits the right topics and in the right order to answer the many questions I had regarding writing patents and patent protection.

5 out of 5 stars Incredible insight with real world value........2003-04-18

Essentials of Patents is destine to become the defacto handbook on the critical importance of understanding patents from a management side. I have over 15 years experience consulting and working with technology driven companies, everything from Fortune 500 companies down to secret two person labs, where I could have handed this book out and become an instant hero. Needless to say, I'm ordering a ton of copies as free reads for my valued and important customers.

This book is not just a book for inventors, attorneys, researchers or managers, but everyone and everybody within corporations where innovation is essential to their core competencies - in other words, any company that plans to be around tomorrow. This book should be required reading for any MBA curriculum, let alone engineering, marketing or human resource manager.

I have witnessed an amazing change the area of patents over the years. I started as an inventor in college at Tulane Engineering, licensed patents to large home health care companies, and created a company to help recognize inventors from a human resource side. What I see Gibbs and DeMatteis are doing here with "Essentials . . ." is dispelling the mystery and complete misunderstanding of this area with an easy to understand and very articulated, astoundingly insight. These guys anchor the essoterica of patents in real world solutions. They answer all the questions that I have been peppered with over the years. But they have gone beyond even those areas that should be familar with patents, and provide insight for all departments, in what my experience dictates as completely accurate. By having read this book, I learned as much about my own area of experience as I thought I had gained over the years. The introduction alone is as educational and significant to patents as differential equations are to linear systems.

This book is long over due, especially in light of the explosive significance of patents in being competitive in the global economy. As companies are striving to innovate, being the only sustainable source of above average returns in the new economy, this book should instill the knowledge to handle this critical area.

This will book will be a free gift to all my clients in the future.
