A surprisingly fresh and impressively comprehensive guide to the convoluted process of custody evaluations. The need for these court-mandated evaluations arises when one of the parents - often, the father - is a repeat offender, an abuser.

Abusers are thought by practitioners of psychology to be emotionally disturbed, the twisted outcomes of a history of familial violence and childhood traumas. They are typically diagnosed as suffering from a personality disorder, an inordinately low self-esteem, or codependence coupled with an all-devouring fear of abandonment. Consummate abusers use the right vocabulary and feign the appropriate "emotions" and affect and, thus, sway the evaluator's judgment.

As Lundy Bancroft correctly observes, Confronted with this contrast between a polished, self-controlled, and suave abuser and his harried casualties - it is easy to reach the conclusion that the real victim is the abuser, or that both parties abuse each other equally. The prey's acts of self-defense, assertiveness, or insistence on her rights are interpreted as aggression, lability, or a mental health problem.

The book draws attention to these pitfalls and provides a through description of the system and its protagonists. Sam Vaknin, author of "Malignant Self Love - Narcissism Revisited".

I can't say I have any great love for the school of thought expounded in this volume. But if it's mathematical models you want, it's mathematical models you'll get in this fine introduction. (Me, I disagree with the mathematical-models approach pretty much _in toto_ and favor the Austrian school of economics -- von Mises, Rothbard, et alia -- on a foundation of rationalism. But my disagreement doesn't detract from the quality of Miceli's presentation.)

In each of the four areas mentioned in his subtitle, Miceli presents a basic "model" in one chapter and then rings the changes on it in the next. His presentation is clear and solid, though it does require at least some background in undergraduate-level mathematics. (And in general, it's a good idea to know at least enough mathematics to overcome the tendency to be impressed by it!)

Readers interested in this field but without much background in math are advised to read Mercuro/Medema's _Economics and the Law_ first, especially the chapter on the Chicago School. I'd personally recommend reading Miceli's book before moving on to Posner's _Economic Analysis of the Law_, Landes/Posner's _Economic Structure of Tort Law_, and Shavell's _Economic Analysis of Accident Law_.

For another good introductory work in some respects "orthogonal" to this one, see Polinsky's _An Introduction to Law and Economics_. In addition to providing a fuller discussion of the Coase Theorem, Polinsky also raises questions about possible conflicts between efficiency and equity. Personally, I don't think this entire school of thought deals adequately with those conflicts, but Polinsky does make the attempt.

Readers critical of "law and economics" and seeking an opposing point of view -- indeed, an opposing fundamental outlook -- might wish to read Ernest Weinrib's _The Idea of Private Law_. (In my own view based on my reading to date, the genuine insights of the "law and economics" movement can be taken up, with appropriate modification, into Weinrib's outlook -- but the other direction doesn't work.)

Thomas Miceli wrote the most comprehensive technical treatment of law and economics. The text contains formal mathematical models with a coherent coverage of the main issues in contracts, property, torts, and litigation. The book is written for an educated audience. Unquestionably the best among the wide-range treatments of law and economics. Comparable in quality and technical sophistication to Posner-Landes's treatment of tort law and Shavell's treatment of accident law.

It begins with the substantive law and practice, and uses this as the basis for a comparative and critical discussion of the private international law issues. Examples of the typical obligations of the buyer and seller are also provided. International Sale of Goods in the Conflict of Laws is a strong new addition to the Oxford Private International Law Series and covers everything from torts to e-commerce. Contracts of sale with a cross-border element are an everyday occurrence and one which is becoming ever more common with the advent of modern communications technology. For example, where, for jurisdictional purposes, is the place or performance of the obligation to pay for goods? Where software is sold over the Internet, is this a sale of goods contract and, if so, where are the goods delivered? Foreign judgments as to title raise complex questions as to enforcement, recognition and res judicata. As regards choice of law, sales-specific problems arise to a large extent from the interaction of contractual obligations and title matters which are central to the sale contract and the complex characterisation questions which ensue. They arise from the enactment in many countries of the Vienna Convention, from the complex inter-relationship between buyer, seller and third parties and from sales-specific domestic legislation which may be mandatory irrespective of the applicable law. The book is concerned not only with contractual disputes that can arise out of the international sale of goods but also with torts, such as conversion and negligent misstatement, that can arise out of this type of contract. Restitutionary and proprietary claims can also arise. Special attention is paid to both the jurisdictional and choice of law problems that occur in cases of business to business e-commerce.

      Exactly what I was looking for to settle a trust. You need to know the basics of trusts but it fills in the rest of what you need to settle a trust.

      I am amazed the author of this book had the nerve to write such a book. I used his company to settle my father's estate-it wasn't swiftOR easy-it was a NIGHTMARE- requiring 4 attorneys, three accountants and 3 years of constant legal work to clean up the mess that his company recreated. My father was middle class and trusted the advise he got from Mr. Abts- his advise ended costing us thousands in legal fees-, and 3 years of constant stress to get the mess he created cleaned up. When confronted - we found that not only was his advise bad but that he does not stand behind his advise or work! we had no legal recourse for his major mistakes as he is NOT an attorney!

      I am in the process of settling a rather simple trust. However, I found this book of no use. Note the author first wrote a book titled "A Living Trust" which discussed setting up a living trust. "Settle a Living Trust" is a rehash of the "A Living Trust" with a little information about settling a trust. I wouldn't recommend buying this book if your seeking help in settling a trust.

      As an attorney specializing in estate planning for 17 years, I found some good ideas in this book. However, there are a number of statements that are misleading at best and flat-out wrong (from a technical legal and tax standpoint), at worst. Still, your lawyer should be able to spot those and it's still a very worthwhile book, on the whole.

      Some repeated sad stories from his first book "The Living Trust". Once past these, there is some very useful info. Read it very carefully, and then take questions to his outfit, or your lawyer, or both. Then advise your next trustees so they know what is coming.

        As a security professional and attorney with more than 30 years of experience, I have used this text in my graduate courses on security case law and security management for more than eight years with more than 400 students at two universities. The clarity of the author's text and the case-based format makes it an ideal text.

        However, without a recent update or new edition, the example cases are now sadly out of date. In addition, newer topics in the area of cyber-security and updated laws on the regulation and powers of private security personnel are not addressed in the text.

        Use of this text now requires considerable work by the professor to bring in new materials and update nearly twenty years of case law decisions. In fairness to the author, however, I am not aware of any text on this topic that is more useful -- even in today's classrooms.

        According to editor David A. Maxwell, the role of subsidized law enforcement is becoming increasingly supplanted by private security personnel (primarily as a result of municipal tax dollars spreading too thin, but also as a buffer to litigation from citizens injured and/or victimized on private property), and as a result, the criminal justice system will be forced to engineer new legal paradigms to control these corporate spaces, what with our "public" environments becoming increasingly privatized (shopping malls, apartment buildings, condominiums, retail outlets, hotels, bars, restaurants, casinos, health care institutions), a postmodern Main Street, fragmented and decentralized. What the industry needs (and what Maxwell provides) are a series of discourses that explore these new legal dangers and issues of accountability, providing a code of ethics for underpaid, underrespected "rentacops" who nevertheless find themselves bearing the brunt of municipal police functionality, badge-wearing "civilians" with limited arrest and investigatory powers.

        Maxwell provides a brilliantly edited anthology of case studies designed for the security manager, but generally used as a supplemental text in university courses on security administration. Recently, however, many professors have realized that merely technical excurses on the security industry tend mainly to put their students to sleep, while oversimplifying the civic answerability issues (i.e. a litigation-happy American society) which haunt every rentacop comptroller (not to mention the citizens who are routinely victimized by poor training, negligent hiring, and cost-cutting managerial tactics). Maxwell's book (and others like it) are rapidly becoming the required text in progressive courses on the subject, useful not only for those working in the industry, but also the network of lawyers, policeman, magistrates, and even potential litigants who routinely come into contact with security officers.

        It is perhaps no accident that Maxwell's selected cases are often highly entertaining in their own right, exploring the legal vicissitudes of some truly bizarre and, at times, unbelievable scenarios. Granted, most of the cases involve the usual synopses of simple negligence, intentional torts, vicarious liability, contract law, false arrest, illegal detention, invasion of privacy, entrapment, et al. But beneath it all, Maxwell's editorial sense of humor keeps a devilish grin on the reader's face, many of the cases giving off that whiff of seedy, voyeuristic pleasure we usually associate with "reality" shows on the Fox network.

        Remember Butterfly McQueen, the Oscar-nominated actress who played Scarlett O'Hara's squeaky-voiced handmaid back in 1939? Well, in her elderly years she had a disastrous run-in a pair of overzealous security guards, who literally *karate-chopped* her to the floor of a Greyhound bus terminal because they "thought she was stealing" (Int. Sec. Corp. of Virginia v. McQueen, pgs. 185-7). Or how about a K-Mart shopper whose colostomy-bag is mistaken for shoplifted merchandise, and unceremoniously ripped out of his colon by a non-English-speaking store detective (Canty v. Wackenhut, pgs. 188-9)? Or a peckish youth who is caught pleasuring himself by a parking-lot security-camera, the tape maliciously circulated amongst the employees of his father's workplace (Turner v. General Motors, pgs. 208-11)?

        I hate to sensationalize what is, in the end, a dead-serious range of issues. There are of course plenty of weighty, somber, tragic scenarios included here as well, where shots are fired, tempers flare out of control, and citizens and rentacops alike end up terrorized, humiliated, beaten or killed. Yet even the most banal of case-studies convey that self-surveillant chill of civic instability, tapping into our personal histories of resentment and humiliation in the midst of public embarrassment and misunderstanding, the abuse of authority, the sense of subtle victimization and entanglement many of us feel in a highly regulated, obsessively policed and hyper-litigious society. Roughly 95% of the cases here involve lawsuits where something goes *wrong* with the security apparatus, and there's nothing that gets the bile flowing faster in our culture than the looming threat of litigation, the gut-churning anxiety of trying to get compensated through the system for the routine abasements of living in a corporatized environment.

        In the end, Maxwell's book has as much sociological as legalistic value. The rentacop, underpaid and disrespected, is becoming an important player in the high-stakes game of public safety and civil liability. But respect and higher wages will only come with a complete overhaul of the industry, both in its ethical precepts and legal safeguards. If Maxwell's book has the influence I hope it will have, then many of us will be able to live in a safer, happier, less persecutory public (private?) environment, with less hatred for the badge, and more confidence in the propensity of private citizens to look out for one another.
