Guys I wanted to ask is there any major differences between the 5th and 4th editions I noticed in the index they added in one more chapter on Discovery in the 5th edition but the rest of the 4th looks identical to the 5th edition. Any one have personal experience with this please let me know, you can reply back in another review here on Amazon. Thanks guys/gals!!
Helped me understand Civ Pro throughout the year.......2007-06-27
If you have a limited budget (and what student doesn't), this book is well worth the money. It clears the fog surrounding so much of Civil Procedure, and my professor even recommended it as a course supplement. I found it was helpful to read this at the beginning of a new subject in class, and it made the readings go faster. It is not an outline, and it isn't a book that's terribly useful two days before the final unless you want to read a few examples on a topic you're feeling shaky about. You have to use it throughout the semester to really get the most out of it, and it's easier to read in smaller chunks anyway. The rest of the books in this series are good, but this one was by far the best of the group, and if you can only buy one supplement your first year, buy this one.
Professor-recommended study aid.......2007-05-24
This is an excellent exam aid for the student who has already put in at least some of the work of studying during the semester but wants to sharpen up in preparation for finals. It is not a quick-and-ready, black letter law outline. It provides thoughtful, accessible analysis of the significant areas of civpro and then provides excellent short essay questions and answers.
This book is best at helping you practice the analysis necessary for perfoming well on essay exams. It is the only study aid my civpro professor recommends, and it helped me secure A's both semesters.

A Civ Pro Staple.......2007-01-14
A must have for any 1L. This book is a staple in the book library of any first-year law student taking civil procedure. It explains everything at an easily understandable level w/ examples and explanations to go along with it.

This is a fantastic hard cover book which relates much of the information needed when working in the related field. Tjompson/Delmar Learning publishers are among the highest in their field. If you are looking for a source on Civil litigation then you most certainly have found it.

This book is very poorly written. There are many typographical errors throughout the book and many, many inaccuracies in the content. Some terms are used incorrectly and instead of assisting the reader in learning civil litigation, it creates confustion and frustration.
I would not recommend this book to anyone - especially students.
I hope the new edition is worth the paper it's written on.
Great source of info.......2001-03-21
For all those up and comming law studients, this is a great information source. Step by step, the steps of the litigation process are illustrated. In addition, it is written in such a way that even a person with no legal background (like myself) can understand it. I highly recomend this book.

A disappointment only because it could be so much better.......2006-04-19
Plainly stated, this is a terribly edited book. Although the authors made it clear at the outset that they are not scholars, that fact is no excuse for the decidedly sloppy, bloated, and ambiguous prose that nearly scuttles this second effort. Far too often, the authors muddle the articulation of their theories and techniques by infusing the prose with vacuous, ungrammatical, and utterly impenetrable fustian. Indeed, any educated person will quickly realize that this book is in need of major editorial intervention.
The sad aspect is that the authors have compiled some excellent ideas and are doubtless highly qualified authorities on the subject. I harbor no doubt that that the theories contained in the book are, in and of themselves, well worth the considerable purchase price. That said, the effort that has to be expended to parse the disjointed, repetitive, and circuitous prose clogging the pages is so great that it renders the book less attractive than it ought to be.
The techniques discussed in this book are so useful and relevant that this volume ought to stand apart as one of the premier practitioner manuals. The content is that good. Make no mistake: these men are good trial lawyers, and they know what works, but a large amount has been lost in translation because these gentlemen are far more proficient at trying cases than at writing books. There is no shame in that fact; certainly, all lawyers have strengths and weaknesses. Nevertheless, there was simply no excuse for not committing this book to the hands of a capable editor. The authors would be well advised to call Bryan Garner and have him polish this book before the third edition is released. With someone like Garner at the editorial helm, this book would finally attain its rightful place at the top of the literature regarding cross-examination.
The best keeps getting better.......2005-01-03
This review is intended as a review specifically of the second edition of Pozner and Dodd's _Cross-Examination: Science & Techniques_ (released 12/2004). Some of the reviews listed for this edition appear to have been duplicated by amazon.com from reviews of the first edition in 1993.
My entire practice was transformed some years ago when I adopted the authors' cross-examination-centered method of case preparation as set out in the first edition of their book (Roger Dodd, by the way, is a co-author of the second edition as well as the first edition). Not surprisingly, because the authors' method enables the lawyer to master case facts quickly and efficiently it is as helpful in negotiating settlements as it is in actually trying cases. I will not say that the techniques are necessarily quick or easy--I can recall spending eight hours laboring over questions for a major cross examination that took exactly one-half hour in court--but it produces stunning, consistent, results.
How does the second edition differ from the first edition? Well, the authors appear to have noticed that computers have been invented. The first edition's defiantly Luddite tone emphasizing the usefulness of manual pasteup of criss-cross charts and such has modulated into a respectful acknowledgement of such things as outlining programs and databases. Second, the authors provide many more examples in the second edition of the uses of the methods in complex civil litigation, as opposed to felony criminal trials. Also, although this book is not, and does not pretend to be, a primer on discovery management in document-intensive cases, its presentation of the concepts enables the reader at least to envision how the systems might be applied.
In addition, when I read the first edition I found the amount of information in this book simply overwhelming. Perhaps because the text is not quite as densely crammed into the page, or perhaps because I have been studying this material for years, with the help of a hilarious audiotape of a Pozner and Dodd lecture, the second edition seems less overwhelming. I noticed that the authors' quirky turns of phrase have been somewhat smoothed out, alas ("sliding off" objections is now described as "dealing with" objections); simultaneously, a number of minor, annoying typos have crept in, mostly errant commas and subject-verb disagreements.
One additional comment about the physical book--it is printed on heavier paper than the first edition. This is a Good Thing. The first edition was on very thin paper, almost like a bible, which made the pages almost transparent; I nearly wore them out. The second edition is more durable and more readable.
The verdict: probably not worth replacing your first edition with a copy of the second edition (unless you never bought the pocket part update on "The Crying Witness," worth the price of the new volume). But if you don't own this book, and you fancy yourself a trial lawyer, what are you waiting for? There are Only Three Rules of good-cross examination, but the Only Three Rules are just the beginning of a durable analytical structure adaptable to all trial work.
Eureka they've got it!.......2004-12-08
Pozner and Dodd's book contains techniques not found elsewhere. I won two hotly contested employment trials for big money in the last 4 months, as a relatively new trial attorney.
If there is one thing better than using these techniques to prepare for and conduct cross at trial- it's watching your adversary fumble the cross making every mistake in the book (this book!)
The writing style is tedious at times, but their essential advice on "only three rules" and the one area per notecard preparation method are invaluable and will save you loads of time!
A Complete but Complex Critique.......2001-11-12
Pozner & Dodd present a very well-organized protocol for conducting cross examinations. The core of their advice is perfectly sound. I highly recommend reading chapters 3 ("Developing a Theory"), 9 ("The Chapter Method"), 10 ("Page Preparation"), 11 ("Sequences"), 12 ("Only Three Rules"), 17 ("Loops"), and 18 ("Trilogies").
Other chapters include useful information, but the authors unnecessarily complicate the practice of cross examination. Few practitioners would have the necessary time to devote to preparing cross examinations as Pozner and Dodd recommend.
The book contains a highly detailed table of contents. You can almost get the full benefit of the book by studying the table of contents.
The Bible of Cross-Examination.......2001-01-12
I found Pozner and Dodd's book the best money I've spent since graduating law school. As a criminal defense practicioner, I live and die with cross. The preparation and presentation skills taught in this book work wonders in the courtroom. The first case I tried after reading this book not only resulted in an acquital based purely upon my cross, but the judge congratulated me later by saying "great cross." Believe me, the price tag is the best money you'll spend.

Difficult to understand.......2003-12-13
Almost no notes or comments on compiled materials in the book. It is difficult to find keys to understand materials from this book without assistance from teachers or study guides. The materials themselves are instructive and interesting. The book becomes voluminous due to the appended rules and their notes. If one has a separate rule book, he/she has to spend more for the unnecessary appendix attached to this book.

Good material---but Outdated.......2004-03-17
The title of my review says it all: the text and the study guide were fine at the time they were published in 1996, but this is 2004 and a great deal has changed in California's court system from the vantage of civil procedure. The publisher should have updated this book no later than 2000 when the courts were administratively unified; additionally, local and state rules of procedure have been dramatically altered to place greater emphasis on ADR (alternative dispute resolution) and the rules regarding Fast-track litigation have likewise undergone significant changes.
In short, a book which purports to teach the nuts and bolts of litigation procedure needs to be revised whenever there are major changes in the procedural law, as has been the case in California.
With that said, the examples, the case studies, and the explanations make this Study Guide an invaluable companion to the main textbook.
Next best thing to the law library.......1999-09-30
I bought this book in preference over several other self help law books I examined after I fired my lawyer and went in pro per. Lots of really helpful, accessible, thorough, and friendly information. In fact it was so good that I promised myself I would write its first online review. You won't get much help on how to act in court, though, as only attorneys can do that and not paralegals, who it was written for. But don't listen to me I'm not an attorney. My lesson in all of this was to stay out of court in the first place.

In Love With His Own Words ..........2004-10-21
This is a tough book to critique b/c my law school recommended it. The author writes a well organized book, but every chapter has been padded -- chapters that could have been concisely written in 20 pages drag out to sixty. Buy this book only if you have to and read it only if you must. You aren't going to learn anything definitive from these chapters and all the practicing lawyers I run into think the authors ideas are just plain silly. The best way to teach about trial advocacy is to include REAL transcripts from REAL cases, not made up stories about fire trucks and people late for work. Those work great -- on paper. Plus the book never answers the big question -- what is the author's ACTUAL TRIAL EXPERIENCE?

A Litigation Essential.......2003-07-30
I bought this book after reading another review stating how superior it was to Mauet's "Trial Techniques." The review was correct. This book can assist the new litigator or can help polish the style of an experienced one. I recently had the opportunity to attend a NITA Trial School and see the techniques in the book in action. You are not serious about litigating well unless you have this book in your library. The book is practical and exceptionally informative.

I bought this book some time ago and refer to it often when preparing for trial, or otherwise when time permits. Having been a criminal trial lawyer for over 18 years, this book still teaches me things that I either didn't know, or that I learned and had forgotten. It is easy to read and very helpful.

Pro - The book offers a ton of practical experience on how to put together a trial step by step and also advice on pretrial discovery.
Con - The book does not go in depth explaining the evidence rules and how each hearsay exception applies or doesn't.
Overally - one of the more easily comprehensible trial prep books for a newly admitted attorney.

Classic McElhaney -- wisdom and wit together. The best at giving smart, efficient and practical advise. i already had McElhany's Litigation -- which i review before every trial. i have recommended him to my best friends who do trials. This is more of the same.
McElhaney's Trial Notebook.......2002-04-17
McElhaney's book contains all of the guidance one needs in order to prepare for trial. From practical guidance for organizing materials to inspirational passages on the formation of the theory of the case and argument, this book has it all. I prefer it to the Mauet book.

This book was suggested to my Advanced Trial and Evidence class in lawschool. I decided to pick up a copy to see if it would really be worthwhile for my future practice since I want to litigate. It is excellent from what I have read so far. Many of us were shown or told how to do or say certain things in pretrial and trial litigation class. This book is not only a good reminder, but it has many other practical and entertaining ideas that I'm sure to use in my future practice. A "must have!"

Hi level book........2004-09-20
The book is keystone for those involved in FEA. It covers all the aspects of Finite Element formulation of physical problems, thought in a more coincise way with respect to , say, Zienkiewicz work and in a less prosaic way. As with many other FE books, the level of mathematics involved in the book is quite high, especially if one considers the non linear finite element formulation for continuum mechanics. Even though the book is mainly intended for structural engineers, it covers fluid dynamics and heat transfer topics. The section I mostly used was the one regarding solution methods for FEM problems: here, Dr Bathe makes a really nice job (about 150 pages). There's a code at the end of the book, it's a FORTRAN 77 one, but one can translate it into a more modern language (I guess we all should get the rid of FORTRAN 77....).
Exercises on non linear FEM tend to be hard, but if you can get the solution book it should't represent a problem.
Two more things: even if the book, as aforementioned, mainly focuses on structural mechanics, there's a common background in FEM problem formulation regardless the particular subject it is intended for.
Second: the book is a very good one, but in my opinion if one intends to study only the basics of FEM, Reddy's book is more suitable for the purpouse. On the other hand, if one intends to pursue a higher level of FEM understanding, this book is a must. This book should be on the shelf of every serious FEM analyst. What's more...I guess Dr. Klaus Jurgen Bathe has to be a very nice person! :-)
Excellent finite element text.......2004-09-08
This is an excellent text for students and practioners alike. The presentation is brief and to the point and focuses only on algorithms and techniques that have been proven to work. The problems are excellent and can only be solved if one understands the essence of the techniques presented. There are many textbooks on finite elements but none so thought provoking as this one. Definitely a must read!

This is the only book I keep reading.
This is absolutly the most valuable book in finite element method area for engineers and students.
There is no doubt.
Do not spend time and money to buy other books.

Prof.Bathe has written this book in a very natural manner. He unified almost all problems by the perspicuous style. Furthermore, several clear examples illustrate you more understanding what his purposes are. However it is suppose that you have some background of FE before starting this one. This is a book I love most.
