Cindy Skrzycki's weekly column titled "The Regulators" has captured the attention of readers of the Washington Post for more than a decade, uncovering the power struggles, political intrigue, special interests and legal battles that go on behind the scenes in Washington. Now, her wit and humor help make the seemingly arcane topic of regulation accessible (and even fun) for readers of her new book, The Regulators: Anonymous Power Brokers in American Politics.

The book, punctuated by some of her most interesting and amusing columns over the years, will make interesting reading for anyone interested in American politics and regulation. Skrzycki's goal in writing the book was to "take a complicated and sometimes inscrutable topic and make it a comprehensible, important lesson in government," (XII), and she succeeds. The Regulators does not provide an academic treatment of the theories of regulation nor details of legal or economic principles. Rather, it addresses the more personal side of regulation: who are these anonymous power brokers determining the legal size of holes in Swiss cheese or the definition of a breath mint? By whom are they influenced and how ubiquitous is their influence in our daily lives?

Followers of her column will be pleased to see that, like her Post stories, each chapter is humorously illustrated by Keith Bendis.

This is a tour de force on one of the most important yet most neglected areas of the law. I took a course from this book, and it was one of the best experiences I had in law school.

This long and often dark chronology is examined with precision, providing Higginbotham ample space to air his own view, that America has come far but still has far to go. Higginbotham, the former Chief Judge of the U.S. Court Appeals for the Third Circuit and the winner of the Presidential Medal of Freedom, is unabashedly liberal, especially in wholeheartedly supporting the concept of political districts designed to create black majorities. His analyses, particularly of major decisions such as the 1857 Dred Scott case, are compelling and elegant. And his indignation is palpable.

      In a matter of color discusses the legalities of slavery in the states of Virginia, New York, South Carolina, Georgia. and Pennsylvania during the colonial period. It reveals how laws contributed to inflicting injustice on millions of Americans, solely on the basis of their color. The State of Virginia, a model of agricultural and economic success, a leader for all the colonies played a major role in the ultimate institutionaliza­tion of slavery. The State of Massachusetts after numerous trepidations abolished slavery in 1783. The State of New York though not steeped in slavery exuded certain prejudices. Although "Free Blacks" might join the militia and buy real estate, Jews were barred from both. In South arolina, by 1708, less than 20 years after the decision to move from white indentured labor to black labor, black slaves out numbered white inhabitants. In the State of Georgia, the indentured slave system broke down. The need to increase the number of white residents and to assure an adequate and cheap labor supply caused the financing of transportation to Georgia of many free unindentured persons (called charity olonists)and granted them up to fifty aces of land. Another group of emigrants (called adventurers) paid their own passage and received up to 500 acres of land. In the State of Pennsylvania the destruction of slavery was achieved to a great extent through the private actions of Quakers and Germans freeing their slaves and cajoling their neighbors to act likewise.

      The book's contents are well researched, with cases and legislation written to be understood. For many readers, even those well steeped in African-American studies or American History, or the law....this book will stir new passions.

      5 out of 5 stars Bedrock. Foundation........2000-02-08

      I highly recommend this book to anyone who wants to embark on the serious study of racial idealogy here in America, especially as it pertains to the law. Higginbotham's work is widely quoted and referenced in other books that I've read. This book forms the bedrock and foundation for understanding "how" and "why" it was necessary to forge a wedge between poor whites and blacks, who together, often conspired to runaway from their master, and how black Americans gradually moved from a position of quasi-servitude to perpetual slavery. This book is phenonmenal. It truly is the bedrock of my collection of works on the subject.

        Supreme Court Justice John Marshall Harlan (1833-1911) is best known for condemning racial segregation in his dissent from Plessy v. Ferguson in 1896, when he declared, "Our Constitution is color-blind."         This book was somewhat useful, but I found it to be not as helpful as a Gilberts Law Summary. The "Nutshell" was, in some places, just as confusing and convoluted as the case book. But it was very helpful in assisting me to understand some of the basic concepts.

        The Administrative Law Nutshell was instrumental to my success in my administrative law class. Gellhorn and Levin (mostly Levin) provide a concise and careful analysis of the often-feared administrative law procedures. The authors provide step-by-step examples and supporting material to help the reader better understand everything from the general principles of administrative law to the dreaded state and local agency procedures. I still keep the Ad Law Nutshell in my office in case of emergencies. A great source for quick and clear answers.

        As Continental forces and Virginia militia units were engaged in winning independence, American quartermasters and provisioners struggled to provide these units with all the necessities of life, from meals and guns to meat, fodder for horses, the horses themselves, firewood, and every other type of material. Much of this was requisitioned from the civilian population and certificates were issued payable in either continental or state funds, depending on the units supplied, upon presentation to court authorities. Thousands of these certificates issued to Virginians were duly entered by the courts, and they provide a fascinating insight into the period of the Revolution. These "Publick" Claims booklets contain interesting and useful information about the contributions of ordinary people to the Revolutionary War. They provide some details of people's service in the militia or as guards for prisoners of war; they indicate where some bodies of troops were at particular times; and they identify providers of horses, wagons, cattle, grain, or other supplies. Much of the information in these booklets cannot be found anywhere else, which makes the surviving records particularly valuable. Also remarkable is the fact that records survived from virtually every county in the state at that time with the exception of the newly formed Kentucky counties. This makes the collection even more valuable in covering areas which heretofore in this time period have suffered from a lack of personal data. The "Virginia Publick Claims" are published by counties. In addition to a faithful transcription by Janice Luck Abercrombie and the late Richard Slatten, a complete index is provided for each county booklet. This series is an extremely important genealogical tool for searchers in Revolutionary-era materials.

        The aim of political race is not merely to remedy racial injustices, but to create truly participatory democracy, where people of all races feel empowered to effect changes that will improve conditions for everyone. In a book that is ultimately not only aspirational but inspirational, Guinier and Torres envision a social justice movement that could transform the nature of democracy in America.

        Racism has been an impediment in living up to our ideals as a democracy. It will continue to be a sensitive and volatile issue here in America unless we make an effort to eliminate it. The authors have done a formidable job in reframing the problem in a way to help us trancend it, come together and work toward a solution to what W.E.B. DuBois called the problem of the 20th century. It's a difficult book but well worth the effort!

        I know that professors from Harvard and UT are smart, but do they really feel the need to express this in their writing? The entire first chapter of this book is nothing but fluff, using nearly incomprehensible $5 words. The authors do not get their point across in a clear and concise manner and the rest of the book suffers because of this. Do not buy this book.

        5 out of 5 stars THIS BOOK RECALLS ELLISON'S INVISIBLE MAN.......2003-07-05

        Because it's the best book about race relations in America since Ellison's masterpiece of fifty years ago. By "race relations" I mean blacks and whites, as Ellison would have meant the words. But The Miner's Canary is about much more, it's about all-minority-cultures and whites in America. And in direct opposition to the color-blind solution the Supreme Court has decided the Constitution requires, the book's authors esteem and celebrate and find strength, including political strength, in our separate cultural identities -- including the separate (non-oppressive) cultural identities of whites.

        When I put The Miner's Canary down, I wished I had read the Acknowledgments first, then the chapter "by" Torres. This is a difficult book, it has many authors, and the voice I identify as Ms. Guinier's seems sometimes to address junior high school students and other times to address law professors. So the book has many levels of analysis, and it treats its central topic -- political race -- from many angles. These are not shortcomings, but they add up to a very demanding book.

        The book's real-life examples, however, are all wonderful and all one -- compelling and utterly elucidating. And the long illustration of how Greek democracy in action would look if it followed American districting and apportionment rules is simply surpassing wonderful.

        Then there's the book's immediacy. The Nobel Prize winning econometrician Robert Fogel has emphasized the roles of technology and religious activism in America's movements for social justice, relegating progressivism to the status of an adjunct to the latter. The Miner's Canary, on the other hand, puts the struggle for social justice squarely within the politics of progressivism. This is not necessarily inconsistent with Fogel (whatever one thinks of the validity of his argument), assuming Fogel's subject is movements in the past before about 1980 when the Big Sleep set in -- which it is -- and assuming The Miner's Canary is describing developments since about 1980, which it is. The book says something new has been happening, and it started being more than unrelated occurrences about twenty five years ago. This new thing Guinier and Torres call political race.

        The ambition, originality and insights of this book far outweigh its difficulties due to multiple voices and an "un-ironed out" presentation. I give it five stars.

        Guiner and Torres write pedantically with little organization or cohesion. Although the anecdotes were interesting, the authors' arguments reek of indolent emotionalism rather than theory and sound policy.

        I realize this is a critical review. I try to be fair to all viewpoints, but this vacuous work warrants these harsh words. Gerald Torres was a visiting professor at Harvard, where his indifferent attitude to his own class and examination live on in infamy. He is not proficient at conveying information.

        In short, while Torres and Guiner intended to write a mentally stimulating book, this work is instead mind numbing. Spend your money on another book. For alternate reading on race theory, try "Unequal Treatment: A Study in the Neoclassical Theory of Discrimination" by Lundahl and Wadensjo.
