Book Description
Addressing a significant void in the extant literature on the topic of domestic violence,
Rural Woman Battering and the Justice System presents a thorough and arresting look at the experiences of battered women in rural communities. While living in the rural areas of Kentucky, Neil Websdale conducted his ethnographic research, and he situated the voices of rural battered women at the center of his ethnography. He clearly demonstrates how rural patriarchy and the insidious "good ol’ boy network" of law enforcement and local politics sustain and reproduce the subordinate, vulnerable, isolated position of many rural women. Taking into account that traditional patterns of intervention can often put women in isolated communities at further risk, the author recommends a coordinated multiagency approach to rural battering that is spearheaded by state feminist agencies. The chapter on the difficulties of an educated male researcher working with rural battered women offers a definite methodological plus. Illuminating and accessible,
Rural Woman Battering and the Justice System makes a most important and timely contribution to the field.
An excellent training resource for anyone working with battered women, especially in rural areas,
Rural Woman Battering and the Justice System is highly recommended for law enforcement and criminal justice professionals, practitioners, advocates, shelter personnel, and advanced students in related courses of study, as well as academics and researchers.

Good book - informative.......2007-01-10
I had to buy this book as part of a college course curriculum.
This book was well written and easy to read. I really enjoyed the material covered in the book.
Of course, the professor of the course I was taking added a lot of personal material which was extremely helpful, but overall this was a great book for the course.
There is definitely room for improvement as there were quite a few grammar and spelling errors in this book as well as two instances of absolutely incorrect legal information concerning family law which the professor had to bring to our attention.
was all i was looking for.......2005-09-20
I got it on time(only 5 days and I am in italy so 5 days is a good deal) the book was new like it was stated, still in plastik

should be 6 stars....tremendous for a man's perspective........2007-08-07
What Every Woman Should Know About Divorce and Custody is a necessary resource for women and men in the process of going through a divorce, as well as for those trying to decide whether or not to divorce, and even after divorce, when custody and child support issues still rear their ugly heads. It is clear, concise, and comforting. This book is a real eye-opener to those thinking about or just starting the process, and provides important information and tactics to all readers about this brutal process. Many lawyers treat the divorce process like a chess game and this book gives you an insider's view of the system. This book arms you with the information to wage the battle. The book is newly updated. It gives good tips on e-mail, virtual visitation, spyware, and other twenty-first century issues that I hadn't even considered. I had read the author's book Divorce and Money and I found this book on custody to be a great help with all of the custody issues.
LOVE THIS BOOK.......2007-03-28
I read this entire book from front to back in 1 day. IT WAS GREAT. Full of useful information and makes you feel that you can do this wether your the initiator or not
About Custody, and a MUST READ.......2007-01-24
I agree that this book is about dealing with a custody battle. If you have children, and are thinking about getting divorced, I recommend you read "Divorce Busters" because the custody process is truly horrible, and because there are a lot of marriages out there that could and should be saved. Unfortunately mine was not one of those, and this book has been invaluable in guiding me through the process intelligently. There are few underhanded tricks listed, which I rather approve of (although it does mention that you should interview the town's "Shark" lawyer before your husband does so that he can't hire him) Just a LOT of good advice! Read this before you choose your lawyer, and you will get a lot more bang for the considerable bucks you are likely to be investing. Read this BEFORE you leave your family home if possible! But do read it; you won't be sorry.
Very Helpful.......2005-09-12
Well written, easy to understand with loads of advice and comfort for those going through the challenges of a custody battle. The author shares some of her own experiences and leaves you with a feeling of hopeful optimism. I consider this a must-read for any parent going through a divorce. I thought that her comments on dressing for court and behavior during separation were common sense, but perhaps there are some readers who would need to understand better how their image and demeanor affect a judge's perception of them as a parent. I would definitely recommend this book to anyone trying to gain custody of their children.
What Every Woman Should Know About Divorce And Cusody.......2004-02-22
This is the most thorough and informative book on divorce issues that I have read. As a divorce attorney, I am always curious to know what other attorneys are thinking. Ms. Smith's perspective and commentary mirror much of my own experiences and conclusions. The book is easy to read and filled with relevant, realistic examples and practical advice. I highly recommend this book to both nonlawyers, who have a reason to learn about this subject and to lawyers so they can refine and expand their knowedge of the divorce process.
Book Description
For the millions of couples who face divorce each year, The Smart Divorce offers an alternative to court without giving up getting what you want
Research reveals that how a couple conducts themselves during a divorce has far greater impact on their children than the divorce itself. Compassionate, clear, and comprehensive, The Smart Divorce is the first trade book to introduce a dignified, highly strategic solution to divorce-the collaborative process, a nationally acclaimed approach that is fast transforming how couples dissolve their marriages, divide their assets, and reinvent their post divorce relationships, particularly when they share custody of their children.
Based on the central tenet that both participants agree to resolve their differences with no intention of ever going to court, the collaborative process focuses on finding common interests while allowing each person in the couple to hire active legal representation. Stressing cooperation over confrontation and resolution over revenge, the smart divorce is beneficial in that it is generally less expensive and quicker than litigation, gives the couple greater control over the outcome of their divorce, and keeps children out of the controversy.
Guiding readers through the steps of the collaborative process so that they may make better, more informed decisions, The Smart Divorce isn't about "going easy" on your spouse. It's about ending up with more money, less stress, and happier kids without going to court.

User friendly book for non lawyers.......2007-03-19
This book gives a straight easy to follow explanation of what to expect in the collaboarative process. The book guides you through the process step by step and includes helpful questionnaires to see if this is a good fit for your divorce. Lots of useful and insightful material in the Appendix. I would highly recommend to anyone, including lawyers, who wants to get a feel for how the collaborative model might be better than a traditional divorce. I practice in the area, and recommend this book to my clients.
The Healthiest Way to Divorce.......2007-01-14
I just finished this book, which was easy to read and well written. I have practiced
divorce law for 34 years, mediated civil and family law disputes for 10 years, completed collaborative
training, and have begun the collaborative practice of law. I am really
enjoying it and plan to change the focus of my practice to collaborative law.
As a divorced father of two adult children, I have personally experienced the dark side of
divorce via the traditional method and hope to offer clients another option to the traditionally adversarial way of divorcing. This book is a great guide for the practitioner and for those who are considering a divorce. It clearly sets forth the advantages of resolving conflict without the use of the adversarial court system method of "winner take all". I am revamping my website and practice materials and expect to incorporate many of the concepts set forth in this book to assist clients in deciding how they want to pursue their divorce.
I recommend this book for clients and practitioners (attorneys, mental health, financial and other professionals).......2006-11-04
As a family law attorney in Minnesota who believes that helping my clients is more important than maximizing my billable time, I am starting to use the Collaborative Practice method in some of my family law cases. After reading this book, The Collaborative Way to Divorce, I decided that the Collaborative Practice method would be better (less expensive with better outcomes) than traditional litigation for many of my family law clients. In family law cases (most often divorce), I frequently recommend proceeding Collaboratively rather than through traditional litigation, especially where children are involved. The Collaborative Way to Divorce leads both the client and the practitioner (attorneys, mental health, financial and other professionals) through both the benefits and the process of proceeding collaboratively. This book is readable by nonlawyers and lawyers alike and I highly recommend it. I regularly purchase a handful of copies of this book to give out to clients, clergy, and others who may be interested in learning about Collaborative Practice.
One of Two Key Books to Read if Contemplating Divorce.......2006-08-09
This book is one which I would recommend to any individual considering a divorce. One of the authors of the book, Stu Webb, is the "founder" of the collaborative divorce movement. The book should be read before selecting and going forward with traditional adversarial representation. There are several pros of the book are that it is written with one voice - despite being written by two lawyers. It is clearly written. The alternative book is the book with Pauline Tessler as co-author. This books is somewhat longer and more inter-disciplinary in its approach. The co-author is a psychologist. If you are looking for the book that is easiest to read yet, by this one.
Great guide to a great process!.......2006-06-06
Collaborative law is the new divorce revolution and this book is a wonderful, easy to read, well-organized guide. If you want to have dignity, integrity and civility when you and your spouse part, READ THIS BOOK!

Good book.......2007-09-28
I used the book. However If your spouse gets a Lawyer you have to get a Lawyer. The programs on CD cost about $25 for the full version but its worth to know what you are in for as far as vaginamony and Child support.
You can do it all with this valuable title,.......2007-06-14
Nolo Press was founded in 1971 specifically for the purpose of publishing the first edition of this title. The Nolo principle is that not all legal transactions require retention of a lawyer, and in the state of California, for an uncontested divorce between two parties, tens of thousands of dollars in legal fees can be saved with the purchase of this $30 title (which is regularly 30% off from Amazon).
This book is a step-by-step guide to the divorce process and each of the forms necessary for filing for divorce in California. The text explains the hows and whys of the filing process and warns of potential pitfalls that can cause filings to be rejected or invalidated in the future.
My husband and I separated after a two year marriage and worked amicably through the process with the aid of this book. We knew that we would save a bundle of money by avoiding hiring lawyers to do discovery on our behalf, and we wanted to split up our property and move on as painlessly as possible. We each purchased a copy of this book and used it to file all the forms in our county courthouse. There is a helpline for telephone consultations at a reasonable rate, and we spent a few hundred dollars to get advice on the Separation Agreement we had drafted together (detailing financial and personal property separation as well as our agreement on our joint mortgage). We got big bang for our buck by having a helpline lawyer personally go over our Separation Agreement and we were confident with filing all the paperwork ourselves.
This book is intended for unconstested, fairly amicable divorces. If one party is out to "get" the other, the services of a lawyer may be required. Nolo recommends mediation before litigation if at all possible, to save money and effort. The authors remind the reader that lawyers do not have the consumer's best interest at heart--their first priority is to protect themselves from malpractice lawsuits, and so they will be as thorough (and costly) as possible to meet that need.
If you are considering leaving your spouse and do not anticipate an amicable divorce, I would recommend purchasing Nolo's Essential Guide to Divorce instead of this book. That has all of the overview information of this title, with additional specifics on mediation and litigation that will help your case if it is going to be in those arenas instead of the do-it-yourself category.

It is a briefer, less expensive paperback book ideal for shorter courses or for courses that supplement a paperback with state-specific material. Chapters 2-5, most of Chapter 1, all cases, appendices, and assignments that require library research have been eliminated in this version to provide concise, accurate coverage with an emphasis on practical paralegal skills and techniques. A Nice Springboard for Discussion in Class.......2007-06-01
This is a terrific reference and a springboard for discussion in class, but as far as books go, it's nothing so terrific that would turn me on to mediation if I were in a book store flipping through books for something to read.
The book is easy to read and follow as far as topics are concerned and if you need to look something up, topics are easy to find and outline.

Divorce & Sanity.......2006-08-01
I give this book to all my clients at our first meeting. This book will help divorcing couples stay sane and get what they need out of their divorce process. Every chapter has guidance and words of wisdom. I recommend this book to every person who is thinking of, or going through, divorce.
It ruined MY LIFE.......2006-03-29
This was the only book I bought in '92 a year before my divorce became final. I was really in need of solid advice, and got rooked.
Any attempt I made to follow this author's misguided logic, only secured my place in the "Suckers Hall of Fame."
Things like; 1) give the woman more alimony to releive HER money-stress and she'll remarry sooner, and get off your back! Baloney! 2) legally tie your child support increases to a yearly cost of living index found in the Wall Street Journal or 3) why not suggest the child live in the marital home while the parents move in and out for visitation... yea right!
If I rememebered anything from 1993, it was how I trusted this author during the most difficult time in my life, only to be fooled with his idealistic, liberal views of divorcing couples. Hey, SAM, most people don't have alot of money and they still fight. Got any good advice for the majority? I didn't think so.
Don't buy this book, I'm surprised it is still around! I gave it 1-star because I had to.
I saved thousands!.......2004-02-10
Many of our friends have spent thousands on lawyer fees and ended up frustrated and bitter. Following Sam Margulies' advice, we were able to work out an equitable divorce settlement that was approved by the court within a month of the final divorce decree. Our total fees were less than $1000.00, and our relationship has remained good enough to make decisions about our children together with the kids' best interests in mind. Unlike others we know, we've both been able to move on with our separate lives.
My kids are glad that I read this book.......2002-07-10
My kids are happy because their father and I have had a truly amicable divorce. We work cooperatively as parents, so our kids have adjusted well although the situation has been painful for them (and for us). This book helped us to work out tricky custody and financial issues. It helped us avoid costly adversarial litigation. The book is sensible, down-to-earth and filled with good solid advice. We were fortunate enough to live in close proximity to one of Dr. Margulies' two locations of practice (NJ and NC) and to work with him personally on issues we could not resolve on our own. He is as excellent in person as he is in print! He has a good sense of humor, lots of compassion and a wealth of experience in dealing with sensitive subjects. I highly recommend the book, and I also recommend him as a mediator.
Managing divorce without the usual traumas.......2002-05-24
A clearly written book that tells you what to do and how to avoid the legal traps that can get you caught up in a web of anger, endless money (to the lawyers),and frustration. Everyone should read it before they make a mess of their divorce. Hats off to Margulies.

Customer Reviews:
Concise, well-written, authoritative.......2004-12-14
"Nutshells" are not just for slackers who blew off the semester and need to cram at the last minute. I've been consistently impressed with the quality of West's Nutshell series. They're excellent study aids for summary, clarification, and getting the key points and big picture. This one is written by two prominent scholars in the field, the senior of whom (Harry Krause at Illinois) is also the lead editor on one of the major casebooks (Krause, Elrod, Garrison, Oldham, Family Law: Cases, Comments, and Questions). Thus this little book is epecially valuable if your class is using that casebook.
This nutshell provides an excellent tour through all the major areas and issues of family law. There's a nice balance among history, leading cases, and commentary on how the law is evolving. It's short, concise, and, as the authors are not afraid to be droll now and then, a breezy, interesting, and pleasant read.
