Well worth the money for the do-it-your-self-er, small business!.......2007-07-26
After careful research, I choose this Nolo book when it came time to license my company's software. I guess it's silly after spending so much moola to develop software, to not go to an attorney, but I like to think I can figure out all this stuff on my own. I looked at a lot of user agreements online, I figured I could just put together something the big guns paid a lot of money for. If their agreements worked for them, they should work for me. But, I didn't want to plagarize them, and, well, you never know what you don't know and you can't be too careful in business these days. What you don't know is what will bring you down. I have used many NOLO books as guides and trust them. They are always easy to skim and read. I also bought Quicken's Legal Business Pro 2007 software. The sum of the 2 is way less than attorney fees, and now I understand it myself as well. I am so happy I bought this book with a CD because it made me realize how important it is to also protect our work with copyrights, trademarks, agreements, etc. Most importantly, I found out who owns the software we paid to develop, and it's not us, surprisingly! So I have to get that signed off before I can license it to someone else. It's not in depth but I don't think it's meant to be, it's a GUIDE, people. Now I will buy NOLO's books to guide me through the process for legal protection. The employment & consulting agreement chapters were not useful to me, but they may be to someone else. There are other books devoted to that and NOLO has them too. (check out their website and e-mail newsletters.)I feel I got more information than I expected and know what to do to take the next steps. Very important info for CA users, the laws are not the same as other states,(what's different?) and this book points the differences out. The format is such that one is able to cut and paste together the different parts and verbiage you need which will apply to your needs. Buy the book and get your bright yellow highlighter out!
Fastest, cheapest, 200-level education out there!.......2007-04-18
Nolo delivers again with its guide to web and software development. The book is easy to read, has sufficient tips and examples, and is a great primer.
It does not get into incredible detail on any one subject, but that's not its purpose either. It gives you sufficient resources (including the necessary forms) to get a software company or product started. When the product / company start growing fast, it's worth doing a review with an attorney, but not until then.
I recommend buying this if you are: a software developer looking to go freelance; starting a software company; or doing any consultant work in web or software development.
Excellent Legal Contracts.......2006-10-18
I found this book most useful for the CD-ROM's legal contracts. As a consultant, I use these for all my clients.
I have found my clients legal contracts to be biased entirely in their favor rather than this CD's contracts which tend to be fair and balanced, protecting both parties.
Good content, bad editing.......2006-10-16
There is a lot of good information and discussion in this book about the topics which a contract should cover. It falls down, however, when it comes to the actual contracts. Just comparing the website and the custom software contracts, there are differences where there shouldn't be. In the software contract, it's the Customer, in the website contract, it's the Client. A bit more than half of the contract sections with (mostly) identical headings and purpose have unexplained differences between them. Many of these differences are not trivial. In the text, the contracts are interleaved with explanations, but often the commentary/annotations are just restatements of the contract itself, which is a real time-waster, especially if you've read the background material earlier in the book. Other occasional editing snafus include explanatory comments inside the contract text, formatting syntax commands on the page (END SECTION), and a less than clear and concise structure for indicating optional clauses (the intended combinations aren't always clear, even though customization is to be expected). Given the fuzzy line between a website and a web application (ie 'custom software' (and really, what website is NOT custom?)), and given the marked similarities in over half of the two contracts, why not cover the overlapping sections just once, instead of twice, but inconsistently? And the sections that don't overlap, or overlap badly? No real explanation as to the reasons for the differences. I hope I don't have the same problems with the two versions of the independent contractor agreement. Fishman has written a pile of legal books for the layman, including the more recent "Consultant And Independent Contractor Agreements 5th Edition". I have to wonder: "Quantity over quality?" Perhaps when he is working on the next edition of this book ("Legal Guide to Web & Software Development", due out 8/2007), he will take the time to re-organize some of the content and get a capable editor. A determined reader can sort out the differences on their own, but it need not be so difficult. The content is 5 stars (including 24 documents in RTF format), but making it work for you is a real pain if you care about details.
This Book Delivers.......2005-08-09
A straightforward and well organized book.
I needed a brief on copyright ownership, a draft software licensing agreement and a software maintenance agreement. I got all 3 with this publication.
It is nice to find a book so fit for purpose.

This book is very readable. It's written in plain language, easy to follow, and the law is explained concisely. All of the topics covered are very current and there was a lot of practical advice and useful information about how to avoid legal problems and comply with the law.

I just received a copy of this book & had I known that the original price was just $17.95, I would not have paid so much money. Not only is this book overpriced, it is dated. Although there is some good information in this book, alot has happened since 2002 & there are better resources out there that are more current & don't cost a small fortune.
Buy the e-copy, or get something more current with just as much information like 'Issues in Internet Law'($17.71)

In a digital world of sequential processing, the Guide panders to our human parellel processing capabilities. Pattern is social impact, law involved and case study ... not necessarily in that order. Information is up-to-date. Purchased both the book and the digital copy. Love the book; have rarely used the digital except for keyword lookup. What truly makes the book worth five stars besides competence, is the choice of topics. So if you are into digital dirt such as software copyright violations, cybersquatting and digital trademark infringement ... this is a must-have book for you.

This is a great book-- it does an excellent job of explaining the concepts underlying the law and teaches you to THINK in legal terms. In that sense it is timeless...The author does a great job of explaining concepts and avoiding mumbo-jumbo.

Pros: Easy to read, comprehensive, good for law students, lawyers, and lay people alike! Read it, and you'll have complete understanding of current and past internet law.
Cons: the gigalaw.com website is more up to date.
As a law student, I took an internet course. Gigalaw Guide to Internet Law was, by far, my best resource. It wasn't an official text for the class, but I found it far more useful than the books we had to read. It supplied great examples to illustrate applicable law. I used it to study for exams, and it gave me complete coverage of all course topics.
Also, it really doesn't read like legalese. You could keep it on your coffee table for light reading.
If you are a business person who has to understand internet law, I highly recommend you read this book -- you'll learn all the same things that I learned in law school and will one day charge hundredss of dollars an hour to explain to you :) If you are a law student, this will serve as a great study guide.

A huge waste of time and $$$.......2003-07-30
If it was allowed I would give this book a big fat zero. Alas, one star is as low as it gets. It skims over everything. Nothing practical in here. If you feel compelled to get this book buy a used copy. I am in the process of reading "Start Your Own Business" By Rieva Lesonsky which proves to be a great resource.
Extremely Helpful and Interesting!.......2003-01-29
I found this clearly written book to be helpful and even sort of interesting to read. It covers various aspects of setting up a business that uses a website and also setting up the website as well. (I didn't realize that many legal issues could affect your website, such as copyright issues and other publishing laws.) It also provides some fundamentals about contract law and system development you need to know in order to put a website in place. It is a good practical mix of legal and business advice. The sections on how to go about actually building your site, what functions and what content should be on it, are informative and full of issues that I would not have thought of on my own. The book is in a handbook format, and I will probably also refer to it with various questions as I go forward with the process. It also has forms in the back that I can fill in to create a budget. My business is a start-up but it seems like this book would be helpful for anyone who needs to know the legal and practical issues surrounding their business's website.

A Valuable Book.......2006-01-21
Some inventors and entrepreneurs may have become gun-shy about utilizing the Internet to promote their products after the collapse of more than 100 dot-coms and the disappearance of 40,000 dot-com jobs in 2000. However, the fact remains that the Internet has become a powerful business tool not only for "new economy" companies but also for "old economy" companies. This book provides the basis for making informed decisions for selecting, maintaining, and using domain names to promote your product or service.
The authors immediately make the point that "Choosing a name, or more than one, for your web site is no trivial matter -- your decisions can make or break your business". They offer as proof as to the value of a good domain name the fact that one such name, just the name itself, sold for $7.5 million!
The book details how and where to register your domain names. Network Solutions Inc. (NSI), is the current dominant register, but others are listed and their web addresses given. It is vital to be the "senior user", i.e., the first to actually use the name. This applies to any domain name and in particular to when your name is also a trademark. It is also vital that your name be distinctive and that it avoids confusing customers by its spelling or by the sound of the name. The authors quote George Eastman's famous advise about name selection -- "Be short, be vigorous, be easily spelled, and mean nothing". They note U.S. trademark laws specify six types of names that cannot be used. One such category consists of names that "contain immoral, deceptive, or scandalous matter".
If you wish to sell or buy a domain name, the book provides a domain name transfer agreement form. A chart is given that lists the various factors to be considered if you discover someone is using your name or an excessively similar name.
You must be alert to "cybersquatting". That is others using your trademark as a domain name. In 1999, Congress passed a law against such bad-faith use of names.
In about l5 minutes, you can now search the U.S. Patent and Trademark database for registered or pending trademarks. The book gives directions and screen images of this site. A great deal of time, money, and grief may be avoided by making this simple trademark search. The book also lists other sites, such as www.thomasregister.com, for currently used commercial names.
Always remember that the "likelihood of confusion" is often the key ingredient in trademark hassles. Many court decisions have been made in this area, but it is still a gray area in some cases. The authors devote a full chapter as to how to register your domain name as a trademark in the U.S. Patent Office. Having a registered trademark is a powerful position to be in if a legal dispute arises.
Another chapter, "Help Beyond This Boo"," provides information as to where to go to do legal research regarding federal laws. It also provides advice for finding a lawyer who is competent with regard to trademarks and who is respectful, honest, and conscientious. Uncontrolled "billable hours" can ruin you financially. Read this section well.
The book's appendix contains a complete listing and explanation of the 42 classes into which trademarks are divided. Also, several pages detail how recorded computer software now is assigned to various classes.
In common with other Nolo publications, this book does a superb job of explaining, in plain English, the practical and legal aspects of the subject. This book will not make you into a domain name lawyer, it does not claim to, but reading it may save you a lot of grief down the road.

I think this book is worth every penny. It helped me to find best sites and deals on domain names. It also taught me how to protect my trademark and keep all my whois info private.
I've learned so much about domain registrars. Choose the registrar which is right for you!
I would like you not to make my mistakes.I had a pretty bad experience with GoDaddy. Yes, they seem to be cheap but then u discover hidden hooks and fees and need to pay extra $$$ :(((( I just transferred my domain to http://mapname.com for $6.85..And for this price I've got Free URL forwarding, Free Unlimited private emails, Free Private POP3 email box, Free Dynamic IP support, Free Spam protection....
They have private registration for free..I wonder why I've paid extra $9 to Godaddy ?

OK for Small Businesses.......2002-11-28
A better title for this book would be "How to Choose an OK Name for a Small Business."
As another reviewer noted, this book was written by lawyers, who seem to know more about law than marketing. Consequently, the marketing advice is rather basic, but correct in my opinion. This is exceptional considering all the bad advice out there on domain names.
But if you are a small business, you don't need a great domain name, and it's not cost effective for you to spend thousands of dollars or many hours choosing a great name. An OK name with no trademark problems will do for most basement, small and garage businesses.
Written by lawyers, this book has good trademark advice. If you are looking for marketing advice for a larger business, look at "The 11 Immutable Laws of Internet Branding" by marketing expert Al Ries, "How to Select & Buy an Elite Domain Name" or other books on branding.
Worth the $20.......2000-08-08
This was the second book (there are only two in print
) I bought in my quest to understand the domain name business. It does provide some useful information on coming up with your own domain name and it does provide lots of info on trademark considerations in choosing a domain name. It is primarily for the trademark considerations that I give it the three star rating. While the Ronan's book on Domain Names (The Domain Name Handbook; High Stakes and Strategies in Cyberspace by Ellen Rony, Peter R. Rony) does a nice job on covering trademark history, this book does a better job from a "How-to" point of view, which is not surprising since it is published by an interesting publishing house, Nolo, which puts out lots of how-to law books. I expect to order more of these.
By my read, about 55 pages of the book are clearly related to domain names. The rest of the book is more related to trademark considerations. It's almost as if they took a book on trademarks and modified it and added the pages on domain names.
Since, if you screw up on a trademark factor with even a single domain name registration, it could cost you at least the $16 or less cost of a name registration, this book's $20 cost is well worth the investment and time persuing its detailed trademark coverage, to prevent running into trademark problems.

This book was written by a couple bored lawyers, who know as much about domain names as I know about law. Funny, but you don't see me writing a book on law. Everyone thinks they are an expert, but these two will have a hard time convincing you of that if you waste your money to read their almost amusingly misleading advice.

I ordered this for a class only to find out on the estimated delivery day that it is not available from any sources. This happened at 2 separate and different sellers, one being amazon and the other being a college bookstore. Apparantly it is a difficult book to obtain. If you need this book for a class I highly recommend you buy it from one of the used book resellers and not amazon.com as a new book or anyone else who sells it new and gives a future shipment date. Be sure that it is actually 'in stock' before you order it and check that it is the correct edition.
Useful, but be careful........2003-02-18
The forms needed a lot of tweaking, there were parts that referred incorrectly to other parts. And it is heavily client-centric, I think the book was written much more for the person looking to hire a developer than for the developer.

I found this book to be packed with useful information on how to determine who has rights for what content on the internet, and how you can avoid getting yourself in trouble if you would like to use another party's content. Packed with examples of copyright, trademark and patent information, it lays out a sound approach. Also there are several templates on the accompanying disk that are great, including confidential disclosure agreements. A must-read for anyone "doing" internet content publishing and management.
