5 out of 5 stars OUTSTANDING TREATISE!!!!.......2007-09-11

BUY IT. READ IT. THEN READ IT AGAIN. AND AGAIN. EACH TIME YOU READ IT YOU WILL PICK UP YET ANOTHER USEFUL NUGGET OF INFORMATION. THE UNIQUE THING ABOUT THIS 'BIBLE' IS THAT IT IS USEFUL FOR THOSE WISHING TO PROTECT ASSETS FROM FUTURE CREDITORS, AND JUST AS USEFUL FOR THOSE ON THE OTHER SIDE OF THE FENCE, TRYING TO SEIZE ASSETS AS WELL. A VERY POWERFUL, DETAILED AND GENEROUS BOOK. NOT YOUR TYPICAL A/P BOOK. THE 'RIGHT' WAY TO SAFELY PROTECT YOUR ASSETS.

5 out of 5 stars Asset protection.......2007-05-12

This well-written book does a great job of dispelling a lot of the mis-information that currently abounds in the market place.

4 out of 5 stars Well researched.......2007-03-01

Jay Adkisson is my voice of reason in the field. This is heavily researched brain food for asset protection. The rule of law is constantly massaged and altered as the courts challenge provisions, and I always feel safest turning to Jay for his interpretation. In particular the Albright 291 Rptr. 538 ruling in Colorado has alot of LLC attorneys spooked. I'm sure we'll be hearing from Jay soon on this one.

5 out of 5 stars Above the Norm.......2007-01-17

Asset protection is a good practical sense guide on the areas of trust, business entities and a dose of reality. If your at a point where the accumulated assets is worth protecting for yourself, spouse, kids and family then this is the book to read. Its not too technical but down to earth business sense. I find this book is geared to people that have some familarity with the business environment. If you know why you want to protect your assets then this book is the next step.

5 out of 5 stars No Surprises Here.......2006-05-30

Adkisson and Riser are beacons in the darkness that is labeled asset protection. This book, and the attitudes it sets forth towards asset protection (when that term may be discretely used) are the de facto standard of care and woe be to the professional who believes otherwise. I say there are no surprises because the book is the embodiment of the professional, real life anti-scam viewpoint in this area Jay Adkisson has come to represent. Do not ignore the fact most of these five star reviews are by attorneys like myself who see the aftermath of so-called asset protection, off-shore entities and third world trusts. Don't miss it.

Book Description

To keep pace with the recent major changes in bankruptcy law, noted author Brian Blum presents a completely revised edition of his popular study guide, "Bankruptcy and Debtor/Creditor: Examples & Explanations." This comprehensive text is well known for its effectiveness in helping students understand the many rules, principles, and policies of the area.

Customer Reviews:

5 out of 5 stars Excellent Primer on Bankruptcy.......2007-07-21

I am an experienced lawyer and regularly read books (usually one-volume treatises) outside my practice area. Comprehensive books on bankruptcy are hard to find, and I purchased Blum's for lack of any alternative. The book is well organized, clearly written, and contains a lot of information. Even the attempts at humor are generally successful.

To offer some unsolicited advice to law students, I don't recommend using this or any supplementary texts in your courses. Stick with the casebook and other materials the instructor assigns. It may seem as if this requires more effort to learn the subject than is warranted, but you won't regret it. You'll never have the time once you start working to reread and think about cases that you have while in school. That 3 years may seem like a long time, but if you take it seriously you will benefit significantly throughout your career. It is surprising how often I encounter exprienced lawyers who are ignorant of matters I learned in law school (now long past) and still remember.

5 out of 5 stars The right tools.......2007-04-24

If you are taking an introductory course in Bankruptcy, get a copy of this book - And use it! If your course also includes Chapter 11 Reorganizations, I would also recommend that you get a copy of Chapter Chapter 11 Business Reorganizations: For Business Leaders, Accountants And Lawyers. They are useful before exams. But I recommend getting them at the start of the semester.

5 out of 5 stars Excellent.......2007-04-10

This is a great supplement that covers the 2005 changes in the code. Watch out for other supplements that are still owrking off of the pre-2005 amendments.

5 out of 5 stars Awesome.......2007-01-03

This book made the new bankruptcy code changes actually easy to understand. It saved my life and my grade!

4 out of 5 stars Good job.......2004-05-10

The author did a good job organizing the information in this book.

I would also recommend Surviving Financial Disasters by Tiffany R. Love which comes with a CD ROM and actual sample court documents from someone who has been there and done that. Also tells what to expect after you filed your papers.

Customer Reviews:

5 out of 5 stars Worth the price.......2007-09-30

I used this book to successfully fight a $20,000 debt that was not even mine. It's true that debt collectors do not want you to know your rights. I wrote a total of 4 letters to the agency, gave them documentation on why I didn't owe it (proved that it had actually been paid off) and they left me alone. It even gives sample letters to write. I highly recommend this book based on actual experience.

5 out of 5 stars Decent Book.......2006-05-26

This is a decent book. I am a 3L law student thinking of doing collections. This book is an excellent choice for the average person with no legal education. As a law student though I always expect more though but it does set out the basics in an unbiased manner with the law printed in the appendix. Definitely worth the price.

STAY AWAY from To Pay or Not to Pay: Insider Secrets to Beating Credit Card Debt and Creditors by Stanley G. Hilton. I also purchased that book and it was horrible. Even as a 3L I know that many of the "solutions" he outlines are not realistic (suing a doctor for malpractice to stop a collection is pure insanity). Stick with DiMaggio's book.

4 out of 5 stars Collection Agency Harassment: - ok.......2006-04-17

so -so review, Mostly common sense. But a few good tips on mounting a counter attack although it doesn't let you know the practicalities of enforcing the FDCPA, namely that federal and state agencies typically don't respond to your complaints except with a form letter and no action.

5 out of 5 stars Empowering!.......2005-06-23

This book gave me the information I needed to take control. Collection agencies do not have a right to harass you when obviously you've hit a rough time. After reading this book I am no longer intimated by a letter or phone call because I now know my rights and how I can use them.

This book was a great source of education and empowering!

5 out of 5 stars This Book Says It All!.......2005-04-05

I would first like to state that I read both of Rich DiMaggio's books: Credit Repair and the other, Collection Agency Harassment. I have also seen him speak. He is an outstanding speaker and a really intelligent man. When I get done listening to him, I finally feel like I have power over "the system". Truthfully--he would probably speak for your group, too, because he has a true passion about these subjects. He gives advice based on 15 years in the courtroom against the credit industry.

These are 2 distinct books, and should not be lumped into one category. There is overlap because debt collectors use our credit reports against us, but the similarities stop there. Mr. DiMaggio will teach you how to draft exacting letters of disputes, and where to send them. He explains the intricacies of the bankruptcy law, charge-offs, divorce, false identities, FICO scoring an more. I don't have a clue what Chrissy is saying about misleading titles. This book is the best I have seen.

(By the way, if you go to the web site, the author actually responds to emails!)

2 out of 5 stars One of the worst casebooks.......2007-02-22

This is one of the worst casebooks ever written, although it wont stop the sales because most students do not have a choice of textbooks. The book is poorly edited and leaves out crucial pieces of information (such as which statute is relevant). The book is also in an order that is not conducive to learning the material.

Customer Reviews:

4 out of 5 stars Good overview of a large number of topics.......2006-04-25

This book covers a lot of ground. As other reviews have pointed out, one consequence of this is that there is not very much detail on the implementation of most strategies. If you decide that you are interested in implementing a particular specific strategy you will likely need to look elsewhere for full details about that strategy.

pro:
* Good overview of a large number of topics including some very important ones like IRD (Income in Respect of a Decedent).
* In my experience, the authors are responsive to email inquiries.

con:
* The book refers to the website for details on a number of topics (mostly for state-specific information). The website, unfortunately, does not have this information on it (as of April 2006),
* Although most examples in the book were fairly good, I found the one for the Charitable Remainder Trust (p326) to be missing too much detail and to be outright misleading. This example compares the average payment over 40 years from two strategies and concludes that one is greater than the other because (in part) it has a higher average payment. The example should have compared the present value of the two cash flows rather than their average over 40 years.

1 out of 5 stars A sales pitch that lacks any in-depth info........2006-02-28

The book is poorly written and largely a superficial analysis of the issues. It was not until after the first 150 pages that I first learned something. This is clearly writen as a marketing piece for the authors. And, when you do go to the website where various additional promised information is supposed to be, it is not there.

That is not to say that I did not learn anything, I did. But on those subjects, I still need to turn to other materials to learn anything that can be put into action.

5 out of 5 stars A Must Buy and A Must Read.......2006-01-29

I am a 49 year old executive and have been doing retirement planning in earnest for at least a decade. I have read many books on retirement, wealth, and other personal financial topics. Most of those have either been overly general, too mathematical, or have been far too narrow in scope. This book is written in clear, concise language and is a treasure of knowledge...including the pitfalls in our tax and legal system and how to avoid those pitfalls. There are great ideas in here and some eye-opening revelations for those unfamiliar with some estate and tax issues. I highly recommend this book for anyone seeking to structure their will, trusts, and overall personal financial structure so that after-tax and after-death returns are maximized for you and your loved ones.

5 out of 5 stars Clear and easy read book.......2004-03-28

I could not believe how easy it was to read and understand some of the complex issues in this book. The authors not only really know their stuff, but they can explain in a clear fashion. It's excellent!

3 out of 5 stars Nice Outline But VERY LIGHT On Detail!!!!.......2003-05-01

This book will be good if you want to review the components that might make up your wealth protection strategy. However, the book comes up short on the detail needed to understand those components well or to structure a comprehensive plan for yourself.

To get a feel for the lack of detail take a look at the Table of Contents, note that it seems very comprehensive but when you look a little closer you will see that most of the chapters are LESS THAN 5 PAGES! The subtopics in each chapter usually make up a single paragraph with a large font bold heading that takes up a lot of the page.

In short, if you want to get an overview of the components you might ask your advisor to explain to you, this would be a valuable purchase. If you want to understand these things yourself, you will be disappointed.

3 out of 5 stars Compare before you buy.......2007-04-25

Epstein's book was one of the first to provide a concise intro to bankruptcy law. A number of students have found Bankruptcy And Debtor/creditor: Examples And Explanations (Examples & Explanations) easier to understand with regard to Chapter 7 and Chapter 13. For an introduction to Chapter 11, the book that is getting great reviews is: Chapter 11 Business Reorganizations: For Business Leaders, Accountants And Lawyers.

All three authors know their stuff.

4 out of 5 stars Law Student's Opinion.......2007-01-10

I used this Nutshell to help create my outline and fill in holes towards the end of the semester. I thought the book was well-organized and appreciated its explanation of confusing code sections. I wish I had purchased this book earlier in the semester since using it thoughout the class would have been beneficial. Summary: Much like other Nutshells - very helpful!

1 out of 5 stars Better guides are available.......2006-12-31

This is probably the worst of the guides available for bankruptcy law. It seems to have been put together in a hurry, maybe to be the first guide on the market to address the 2005 amendments. I had to look else where after being disappointed with this and prefer the following:

1. Baird's Elements of Bankruptcy (awesome!)
2. Blum's Examples & Explanations

1 out of 5 stars Mad .......2006-03-07

I was tricked into thinking this was the new book that covered the new code! If it isn't the 2005 edition with the blue cover.....then don't put the #$@#$#$ 2005 edition cover on display!!!!!!!!!

Amazon really SUCKS sometimes!!!!!!!!!!!!!

1 out of 5 stars DON'T BUY - OLD EDITION.......2005-10-22

2005 Amendments are not in the burgundy colored BNK law book - they are in the new one. The cover is blue. The burgundy colored one in OLD law. Buy the new blue one (2005) that has the new amendments in it.

2 out of 5 stars Not overly useful.......2007-03-26

I bought the book because the reviews were good but I was very disappointed with the book because it doesn't really cover anything you couldn't just find on the Internet. Each topic is covered in like 2 paragraphs. There is not much substance in this book.

4 out of 5 stars I ain't saying you a gold digger but..........2006-01-16

People only sue other people who have money! This book touches on the important ABCs on avoiding lawsuits, avoid standing out in the broke crowd, and holding assets in anything but your own name without losing control of them. There is a very enlightening section on Life Insurance that was worth every penny in itself. This taps into Land Trusts but for a complete package I found it with Land Trusts by Louis Brown (just be prepared to pay serious $$)because this topic doesn't come easy to me. Never-the-less, this is the book for you if you're ready to protect your ass-ets.

5 out of 5 stars Great Starter Book for Asset Protection.......2005-04-14

On my first reading of this book, I said, "Huh?" Then, I attended a corporation seminar. Both the seminar and Bronchick's book were instrumental in formation of my expertise in the use of corporations for asset protection for my real estate business. Admittedly, this book is light on details, but the diagrams and examples provided more than make up for that. Besides, you should seek professional advice anyway in addition to this material.

This book is a goldmine for the entrepreneur. Not only is the advice great for those of us in small business, but the material is a rich source of pratical ideas you can apply to your operation.

5 out of 5 stars Plain English explanations of complicated subjects.......2003-12-01

Once again, Mr. Bronchick does an excellent job of taking complicated legal subjects and making them readable for the average person. I am an attorney as well, and I often recommend this book for clients to read as a primer to the subject (especially when I tell them what it will cost for an hour of my time to explain it!). There are a few books on the market on asset protection, but this is the only one that is geared towards the landlord or small-time real estate investor. One caveat for the reader- there are some sample forms in the appendix, but they appear to be for example only. One should always review these concepts with an attorney to make sure the forms are drafted to comply with the client's specific needs and appropriate state law.

4 out of 5 stars Easy to read, good overview of the topic.......2003-09-19

This book was very reasy to read, considering the magnitude of the subject matter. Short, but to the point on a variety of topics involving real estate and small business liabilities. I particularly liked the sample asset protection plans laid out in detailed diagrams. The book also covered a lot of things NOT to do, such as "trust scams". There's quite a few legal forms in the appendix, but not enough information on how to fill them out and use them. For my purposes, however, the book gave me what I needed, which is a bird's-eye view and the background knowledge to visit with an attorney to implement the strategies. Anyone who expects a book give them 100% of the information necessary to draft complex legal documents involving all their assets needs a reality check.

3 out of 5 stars Good Information if you're a beginner to the topic.............2006-02-08

This book is very easy to read and provides some excellent general advice and information for readers who are unfamiliar with the topic.

However, it does not provide the detailed information needed by someone who wants to formulate their own tailored estate and/or asset protection plan even though the book implies that it does. For example, some of the 'information' relating the differences between states is outdated and/or wrong.

Read this book for fundamental information and as a wake up call for the need for protection rather than as detailed advice on how you can do it!

4 out of 5 stars Want to protect yourself!.......2005-12-06

Author Goldstein has been an asset protection attorney for many years. His first book, Asset Protection Secrets, was a best seller. This one is for everyone: people with money; people with little assets but they don't want to lose them; young and old; married, divorced and single; savvy or naive.

These chilling words set the tone: "You just never know what a jury will do," and "Juries decide if a case has merit." He states that 93% of Americans have absolutely no lawsuit protection aside from their liability insurance--because we procrastinate and don't think it will ever happen to us.

You don't have to do anything wrong to be sued and lose. You only have to be in the wrong place at the wrong time--or come across some greedy lunatic who things he has a reason to be grieved.

Goldstein's advice and strategies show how you can protect yourself against lawsuits, divorce, creditors, the IRS and other deadly threats to your wealth and assets (money, investments, possession, businesses, etc.).

Bulging with easy-to-understand advice, the book might make you to decide TODAY is the time to start protecting your assets and no longer be non-protected.

From personal experience, I know that money and time spent now can save you a lot of both later. It is shocking that only one in five Americans have even a simple will to define their wishes.

The author ends with four important steps:
1.Commit to action: Set a goal and get started.

2.Organize your team of advisors to protect your assets, including family members, business associates, etc.--people you can trust.

3.Recruit the right professionals: your lawyer, accountant, banker, financial planner/investment advisor, insurance professional--and what criteria to use.

4.Stay proactive in maintaining financial security: Be your own counsel in addition to your advisors; learn, read, be proactive.

Armchair Interviews says: So Sue Me should scare you right into your lawyers and accountant's office, place a call to your insurance man, and generally "look over your shoulder" now that you know how easily you can lose your assets.

5 out of 5 stars I Only Wish I'd Had this Book a Few Years Ago.......2005-09-01

This is a book that I wish I'd had (and paid attention to) some years ago, that is, before being sued for divorce. I then had to learn what he says here through talking to attorneys (at $much per hour this is an expensive approach) and by writing my ex-wife big checks (but I got sole custody of the kid so it was worth it).

Dr. Goldstein is talking about protecting what assets you have (after divorce that may be considerably less than you had before). When your major assets have been stripped away, you still need to protect what you have left, but some of the rules change. For instance liability insurance, if you carry a million dollar liability policy and have only $10,000 in assets, this may entice a hungry attorney to sue you while if you only had $20,000 in insurance, he may go look for another target.
