Saved Me in Constitutional Law.......2007-09-01
If you are a 1L taking Constitutional Law, GET THIS BOOK. As a 1L, I found the Con Law cases (especially the older ones) hard to understand and confusing. Chemerinsky writes in clear and concise language and really helps point out the issues and underlying implications of Supreme Court decisions to 1Ls who are unused to reading such long decisions. I recommend reading this book simultaneously with your case book just to make sure you "got it."
Without question, the best Con Law book available.......2007-06-23
It is hard to add to what the previous reviewers have stated. Howecver, simply adding another confirmation to a prior review would not do this book justice. Therefore, I felt compelled to write a seperate review.
Without this book, I would not have passed Con Law.
This is indeed an excellent book in that it puts the different parts of the subject into context. The author does a great job of clearly trying to explain what the reasoning is behind the concepts and how the whole subject is supposed to fit together. Unlike most other books, the author actually is successful in doing this - so by the time a chapter is finished, the reader has a very good grasp of the topic.
Essential for Con Law.......2007-05-23
I cannot say enough good things about this book. Chemerinsky takes the most difficult and complex con law issues and explains them with such clarity: "this is what the court said...this is what it means." I had a great Con Law professor, but I doubt I would have passed without Chemerinsky. In fact, I bought this book because my professor told me she refers to it when she wants to brush up on a particular issue.
Further, this is a book you'll want to keep. Substantive due process, equal protection, and other con law issues pop up in most areas of law. You'll be glad to have this book handy when they do.
Greatest book ever........2007-05-19
I stopped reading my Con law casebook about 2 weeks into class and started reading this instead. This book saved me from certain failure in this class. The single best thing about this book is that he puts everything in context. I think failing to connect the dots and understand how concepts are related to each other is what makes this course so difficult. Erwin is the man!
I used the older edition, which worked out just fine and was much cheaper.
A Must for Difficult Con Law Classes.......2007-05-13
Chemerinsky's assessment of constitutional case law is brief, clear and easy to read. The book itself is beautifully structured and contains every critical case up to 2006.
Only one Caveat: Chemerinsky is a highly lauded and respected Constitutional scholar, but his viewpoint is his own and it comes out in his case redaction and descriptions. Chemerinksy is perfect for tying the bigger picture together, but it always is a good idea to read the cases yourself.

This booklet helps explain our founding documents. Everyone in the US should read it.
Revised indeed. Whose Constitution is this?.......2006-07-05
Buy it only if the price is 50% off. That's because the first half of the work is a poorly written interpretation of our nation's most sacred document. Thankfully, the actual Constitution is provided in the second half. In the first 60 pages, the left-leaning declarations are so bizarre, it is hard to consider this book a serious work.
Mr. Cullop claims that the 16th Amendment allows for economic redistribution through Federal income tax, "The higher the earnings, the higher the percentage collected from them." This concept comes from the author, not the 16th Amendment.
Cullop also settles the controversial 2nd Amendment by declaring that the people have gun rights only as they apply to the militia. He repeats this interpretation at least two times in the test portions of the book without offering any dissent. Interestingly, the author's aversion to gun rights collides with his need to define all but basic words: "...may keep and bear (own) arms (weapons)." Hopefully, most readers know that "bear" in fact means to carry, not own.
The parenthetical definitions of even the most simple terms are so frequent that the book is often difficult to read: "Congress has the power to enforce this article by appropriate (necessary) legislation (laws)." Most readers aside from small children can probably do without "tyranny" being defined as "unusually harsh rule."
Mr. Cullop either lacks understanding of the basic concepts of the Constitution, or he makes very unfortunate choices in language: "Q: Have women always had the right to vote in the United States? A. No, they were GIVEN THIS RIGHT [emphasis added] by Amendment 19 in 1920."
If this irresponsible analysis of the US Constitution was written for children, it should be marketed as such. And if so, impressionable young readers should be especially discouraged from reading it.
A simple but great intro tour through the Constutution........2005-03-17
This is a nuts and bolts introductory book on the Constitution. It definately dosn't analyze anything to any degree whatsoever, but if your looking for that there are plenty of other books to consider. This is one to start with.
I liken it to a foreign language text where you get A LOT of instantaneous feedback in the manner of quizes and fill in the blank questions. Thats the best part of the book. It somewhat forces you to remember (at least once) the prime points by asking you about what youve just read.
Read it often.......2004-08-25
About a year ago, I saw a movie called The Revolution Will Not Be Televised. The movie is about President Chavez in Venezuela and the failed coup attempt on his presidency. In the background coverage of his presidency, the filmmakers recounted how as President, he encouraged his citizens to read their brand new constitution and learn it. They interviewed some Venezuelans who did not know to read, but had learned to read by reading their constitution.
I was touched by this, but then I thought "how many Americans can say they've read the Constitution?" My guess is probably not many. And those that have only did it for school and have since forgotten much of what they learned. Personally, I remember having to memorize the Bill of Rights for a class, but that's about it.
So I bought a copy of the Constitution for myself and began reading it.
In a time when Congress is passing legislation that infringes upon the rights guaranteed us by our Constitution, it's important now more than ever that we read and understand it.
Too simplistic.......2002-02-24
I know this is intended to be very simple, but the commentary is just too simple. It asks questions or states facts that are nearly identical to what the actual text of the constitution reads. This would be a good book for kids, and it is still a good buy if you just want to have a hard copy of the constitution on hand. But in general, I don't think the commentary added anything to the original text.

Until the present decade, constitutionalism in Eastern Europe was considered to be an outmoded concept of the nineteenth century. Changes in the region, however, have brought back the fundamental question of the need to restrict government power through social self-binding.
This book discusses the mechanisms of such restriction, including different forms of the separation of powers and constitutional review. It relates the theoretical and practical importance of the issue to the present world-wide discontent with majoritarian democracy and the growing disrepute of parliaments. Increasing executive efficiency is, however, a threat to fundamental rights, and the battlecry of efficiency is often only a means to new despotism and inefficiency. A careful re-evaluation of the concept of constitutionalism assists in the search for a useful balance between majoritarianism and rights, and in the avoidance of all forms of public tyranny.
Written in non-technical language and using the most important English, American, French, and German examples of constitutional history, the book also examines East European (in particular, Russian) and Latin American examples, in part to illustrate certain dead-ends in constitutional development. It is intended to be an introduction for all those concerned with liberty.

Law and Public Choice aims to be an introduction to economic models of rational behavior to explain the workings of political institutions in modern democracies. The book summarizes the strand of research in public and collective choice (or positive political theory, as American political scientists would rather say), that is, the fact that democracies require people to organize themselves to decide by voting how to allocate resources to public goods. Of course, the task is much more complicate than individuals have to face when to decide whether to buy cornflakes or Nasdaq stocks. Thus understood, the book leaves out the law and economics, and the comparative law and economics traditions. The book was released in 1991 and is now a little outdated and focuses too much on the American system. It is not a comprehensive text. For that the reader should consider Muller's Public Choice III or Cooter's Strategic Constitution, which are updated, comprehensive and devoted to students.
Despite its caveats, this book is well written and engaging.
Lacks Aim.......2003-07-27
This book purports to be a introduction to public choice theory as it interacts with the law. Public choice theory is a framework that analyzes the behavior of public structures under the assumption that all relevant actors try to maximize their self-interest. This book uses public choice theory to analyze (i.) interest groups, (ii.) the democratic process, (iii.) economic regulation, (iv.) statutory interpretation and (v.) public law.
While readable and engaging, Farber and Frickey's text suffers from several defects. The defects are representative of its lacking as an introductory text. First, while this book packs a lot of information into roughly 150 pages, it is not comprehensive by any stretch of the imagination. Topics in areas such as torts, and law and economics are saliently missing.
Second, this book aims to be a "critical introduction," which means that it is a biased introduction. Clear and intentional bias defeats the purpose of an introductory text, which is presumably geared towards promoting understanding rather than agenda. The authors obviously have qualms with public choice theory's widespread application in libertarian thought, and thus they try argue against mainstream public choice arguments for the textualist readings of statutes, criticism of democracy and the inefficiency of economic regulation. What irked me about this was not the criticisms per se, but the excessive straw-man-building employed by the authors. The political nature of this book is quite simply: to make the reader realize that mainstream public choice theorists' skepticism of governmental inefficiency is badly misguided, if not false.
Thus, this book lacks comprehensiveness, objectivity, and an introductory feel. With that said, however, I learned quite a bit once I got past the political posturing. Lucidly written, the book demonstrates public choice theory's flexibility in handling complicated theoretical issues in political science and law. This book might serve a better purpose as a complement to a more general introduction to public choice theory.

Enlightening.......2005-07-11
This is an excellent introduction to critical race theory. Well-written and supported by fascinating examples, it provides an insightful introduction to the school of thought of which Richard Delgado was one of the founders. The reviewer who found it poorly supported and insighting hate is quite misguided, for this introduction does not draw enormous conclusions but rather makes humble suggestions. It is not surprising that it made the reviewer feel uncomfortable, for nobody likes to admit to his/her racisms, which is actually one of Delgado's ideas. Racism is too loaded of a word and this society needs to develop more vocabulary to describe such emotions/feelings.
Horribly twisted and disgusting.......2005-07-09
This book not portrays every white person in America as a racist, but does so in a racist manner itself. The book cites almost no facts to prove its assertions that whites are inwardly racist because of their being white, and that radical measures such as affirmative action across the board (in jobs, schooling, housing, etc.) needs to become common practice to "overcome the disadvantages of being Black." The book claims to want to help all poor members of society, but mentions poor whites only in passing. The book does not effectively prove any of its claims, instead using obviously exaggerated and unlikely examples to make a point. This book only incited anger in me, not sympathy for the "poor Black man."
Eye-opening! A Safe and Non-Threatening Introduction.......2004-04-12
This book will change the way you view race and ethnicity in America. The authors present material and concepts that have come out of critical race theory in a readable format that is accessible to everyone. Although you may be confused about how to pin down precisely what "critical race theory" is (unfortunately, the authors don't really explain the overarching concept very well), you will be exposed to a plethora of new and radical (?) ideas that no other book or class will likely have introduced you to, such as interest convergence, which is the idea that a law will only change in favor of blacks when it is also perceived as being favorable by whites for whites. There are plenty of anecdotes, cases, and questions to keep you on your toes. This book is written in such a way so that any introductory class in history or sociology could utilize the book. I highly recommend it to professors and instructors of these courses, or to the general reader interested in race in America. Agree or disagree with them, you can't come away from the ideas in this book without thinking, and you'll never look at the legal system in the United States in quite the same way again.
