Michael Orey begins his thorough examination of the courtroom battles against big tobacco by examining Horton v. American Tobacco, the Mississippi case that launched the mid-1980s barrage of legal attacks on big tobacco and led eventually to U.S. settlements of more than $200 billion. As they read about the assault on Brown and Williamson, cinema buffs may feel they are revisiting The Insider with Al Pacino. The book combines a walk-through of the day-to-day legal procedures and motions with a look into the lives of the major players. This well-written volume presents the tobacco case like an engrossing true-crime story, although some readers may find it has too much detail to hold their interest. But while executives searching for principles to apply to their own companies may find themselves captivated, they won't find much here that is generally applicable.

It may seem paradoxical to most that for trial lawyers are not afraid to lose a case. Every trial is a learning experience. You learn about your opponent; you learn about yourself. You try a losing case over and over in your head at night. You learn from your mistakes. You learn from the opposing lawyer. You become obsessed and through it all you learn how to win.
This is the true story of some country lawyers in Mississippi who launched a holy war against Big Tobacco. They were unlikely Davids battling a Goliath.
The country lawyers looked like easy pickings to the big firm lawyers from the big cities. The silk stocking crowd would bury them in paper, bankrupt them in endless discovery, and outdazzle them in court, if the bumpkins ever got that far. These champions of nicotine had never lost a case. The clients had never paid one dime to any tobacco victim. They were the chosen ones, selected to keep the streak alive, to bring home the scalps of the piteous Mississippi lawyers.
Trial lawyers know that a lawyer who has never lost a case has never tried a case. Undeterred by the myth of invincibility of the tobacco industry these dreamers were able to use the industry's incredible arrogance on itself to bring it to its knees. In short, the truth got out, and the rest is history.
If you are a law student or a young lawyer thinking about trying cases for a living, read this book. This is how its done and how you can sleep at night.
Superb Story With Little Heroes And Lots Of Lying Everywhere.......1999-09-14
What an interesting recording how Lawyers violate their own standards of conduct just to win. The book shows how documents about Tobacco were stolen and then how the person who stole them was paid $1.8 million by the very Lawyers he helped to win billions for in fees. Yet, I wondered what those same Lawyers would have the same tactics used against them, how they would feel. But the cause was to show that smoking Cigarettes is evil and not good for our health, yet we already knew this and making the companies admit it was a victory. So in the end whenever someone is being sued and if we applaud those breaking ethics and the laws in pursuit for justice, then we encourage bad behavior. In the end when we celebrate this kind of action how far can murder, threats of murder and destruction's of families will be justified in pursuit of justice? Billions have been made, billions have been won, but by whom and for whom? No one should be proud of their actions as described in the book and if they are they can wonder later what will happen when others use the same tactics are them. What is tragic is Society knew shortly after the Native Americans gave Tobacco to Columbus that it was deadly, but people wanted it, and used it, so the governments created Sin Taxes to help discourage it. It did not work back then and it will not work now. People will be free to do what they want and nothing will stop it. At the same time, no one should begin to smoke or smoke but how do you stop it. The book is a great read. I recommend it highly but read it without smoking if you can!

Great book. As an educator, it was the best one on the market. It only lacks current data, but the new edition coming in a couple of months should take care of that.

I just passed my ASP and this book was an excellent introductory text. While it is understood that many other reference have to be used, I recommend this book as one of the first you review.
Good idea, but flawed execution.......2001-01-11
Although this text does cover a wide range of safety topics, it is somewhat dated and contains a farly large number of typos. Therefore, the reader has to be careful. The book needs to be updated and the typographical errors corrected. If that were to be done, it would definitely be a five star book.

A Tremendous Accomplishment.......2006-01-04
I have been studying product liability law, and handling product liability cases, since 1979, and I have read most of the major works on the subject. Most of those works examine a limited number of subjects from a limited point of view, often evading altogether the thorniest issues. Even the Restatement (Third) of Torts: Products Liability treats many important subjects, such as the meaning of design defect, in a relatively superficial fashion. This hornbook is dramatically different. In what is clearly the work of a lifetime, Professor Owen examines every facet of product liability law from numerous different perspectives, pointing out all sides of virtually every issue with complete objectivity. Scholars and practicing lawyers alike can look to this book for a thorough and analytically sound evaluation of the issues they are likely to confront. Indeed, anyone interested in truly understanding product liability law should not refer to the Restatement (Third) without also referring to this book, both for context and for a candid assessment of the competing views.
The First Place Everyone Will Turn........2005-06-17
This is, quite simply, the best single-volume ever produced about products liability. A Great New Book on Products Liability........2005-04-19
I was very impressed with Professor Owen's new and modestly priced one-volume products liability treatise. Professor Owen is a leading products liability scholar and this book is the culmination of more than thirty years of work in this area. The book is well written and provides a practical, authoritative and comprehensive treatment of modern products liability law. I liked the book's organization and it is easy to find any topic I was looking for. The book also packs a lot of information in one volume. For example, it explores the historical origins of products liability, examines and explains its many doctrinal conflicts, and analyzes the economic and social policies and underlie this complex area of the law. The book is also well researched and the author provides numerous citations to leading cases and legal scholarship in the area. Another plus is that the book is completely up to date and covers many new topics such as negligent marketing, fast food litigation, federal preemption and "public tort" lawsuits against cigarette and handgun manufacturers. Like much of his other work, Professor Owen's book will certainly have a tremendous impact on the future development of product liability law as judges turn to it for information and ideas about products liability reform. I urge students, practicing lawyers, judges and anyone else who has an interest in products liability to purchase a copy of Professor Owen's book. It is an indispensable source of information about this constantly-changing area of the law and I use it constantly in my own work. In my opinion, Professor Owen's book is definitely a "must read" for people is want to learn more about products liability.
David Owen's Products Liability Law.......2005-04-19
I would highly recommend David Owen's Products Liability Law to other law students studying in the area. Owen's language is clear and succinct, and his coverage of relevant caselaw is both comprehensive and current. The text covers the basics of products liability for those unfamiliar with the area, as well as the finer points and nuances of the field that would be helpful to even long-practicing attorneys. The section on special defenses, for example, includes discussion of the intersection between statues of limitations and statutes of repose, a subject many practitioners may confuse. I would recommend the book to law students and practitioners alike.

I'm a law professor who has been teaching Products Liability for more than ten years. It's been that long that students have been asking me to recommend a reliable, complete study aid for this complex subject. And it's been that long that I've been saying, "Sorry, there isn't one."
