    4 out of 5 stars It's a tort's casebook.......2007-07-28

    This text covers all of the relevant legal issues that a typical 1L will encounter during a typical torts class. The text reading is quite dry and some of the case selections that are made will make you smash your head against the desk, all in all its not a bad text.

    Recomend the emanuel outline which is tied to this text.

    Case books have a difficult time getting respect, because they have to include the opinions written by the different judges for the different cases. So, you're dealing with many, many writers, and unfortunately, judges aren't known for their entertaining, flowery prose.

    So, the "authors" of a casebook really only get to throw in a few tidbits about the relevant law in-between a lot of badly written, lengthy legalese. I'm betting that they're limited on how much they can write in-between the case opinions by their publishers.

    That said, this is a pretty decent casebook. Buy it only if you have to. If you have access to Lexis/Nexis or WestLaw, etc., you can always just look up and read the cases online & save the cost of the textbook.

    To really understand Torts, I suggest getting a study aid like Examples & Explanations, which I think is put out by Lexis press or the Professor Series by Gilberts. The Finals series are good, too.

    OK, it's a casebook. By definition it is just a bunch of cases thrown together to demonstrate various areas of the law. But lately there has been a new trend in books for 1Ls... analysis. Sure, this book has "Notes" sections between the cases, but they are little more than hypotheticals or one-line versions of even more cases. What about some essays? Talk about the logic behind the cases or maybe mix in some Law and Economics theory. As a generic casebook this is quite good, but adding a little more than just cases would be outstanding.

    This book is still used a great deal in law schools, but there are better casebooks now with modern, more interesting cases and more thoughtful analysis. Instead, try Goldberg, Sebok and Zipursky, Tort Law: Responsibilities and Redress.

    4 out of 5 stars A Dishy Read.......2007-08-27

    Davidson can always be counted on for a good read. The opening scene of this book is particularly well written and unfolds in with riveting and intense detail. Compared to the other books in the series I think the story is a little grittier than previous books. I'd have liked a little more interaction with Marla. I like the way the characters age and grow during the course of the series. The introduction of Gus, so different from Arch, is interesting. With the exception of her husband Tom being too accommodating, the interactions with the police seem more realistic than in previous novels. My favorite part of this book is the way Goldie dishes up dirt on multiple characters when she starts digging. I also like the recipes being placed at the end of the book where it's easy to find them if I want to try one.

    I have read all the books in this series and have always enjoyed them. They are quick, light and fast read. But this one made me feel like I had skipped a couple of pages or missed something in the last book. The introduction of the Charlie Baker character had me skipping back through the pages, I had know idea who he was and Davidson wrote it like we should all be familar with him????Then as the story unfolded she started to explain who he was, but more of that should have been done in the beginning. The Routt family were more annoying then sympathetic. The psator character wasn't developed enough.I think I cared less about the characters then in the past and there were too many of them and her usual characters (Marla, her son) were shoved in here in there to fill in.

    1 out of 5 stars Expensive Recipe Book.......2007-08-26

    After gamely slogging through 232 pages of Goldy's feeling really, really bad about her friend Dusty's death, I skipped to the end. It turned out that two key characters hadn't been introduced in the first 232 pages (of 420), and that another character had only been shallowly introduced and characterized. Following the obligatory scene with Goldy's life being threatened, there followed a couple of pages of explanation of the perp's motivation that read like a plot outline. Too bad the book didn't live up to the outline!

    The paperback places all of the recipes at the end of the book, instead of sprinkled through the text, which is a more interesting and fun arrangement. The recipes are the only thing that I can recommend--without having kitchen-tested any. However, I doubt that I will be purchasing another Davidson Culinary Mystery after having spent $7.99 for this turkey of a mystery novel.

    This series seems to have been going downhill for awhile now, and this book didn't do anything to reverse that trend.

    I used to enjoy all the characters aside from spoiled rotten Arch, so it says something that he was the least annoying character in this book.

    Goldy is a caterer. Tom is a cop. Yet he thinks nothing of letting her stick her nose into investigations, allows her to look over evidence, go out and interview people, etc. It just isn't realistic. Then again, the character of Tom isn't enjoyable in the least, as he comes across as Mr. Perfect -- the cop who cooks gourmet meals, polishes the furniture and goes into the station late during an investigation in order to help Goldy clean up a venue for a catering assignment. I really don't like when authors give their main characters flaws to seem more realistic, then ruin the effect by giving them a perfect spouse.

    Speaking of flaws, Goldy's continues to be the way she cowers and caters to Arch. It's just unbearable. And with Arch's new brother in the mix, I expect future installments to give us twice the dose of Goldy's lack of spine.

    Even the characters I usually enjoy most, Julian and Marla, were annoying in this book.

    I hope the next installment is better, but I'm not holding out much hope.

    Of this series, my first on CD. I missed the recipes. I know, they are read to you at the end of the "book," but I listen and drive, so it was not a big help. They could be included in the box, or list a site where one can go to DL the ones you want.

    This book was extremely helpful and accessible for illustrating general doctrine; however, although it discusses a smattering of major cases (e.g., Palsgraf) and other minor cases that may or may not appear in your torts textbook, it does not provide substantial depth for these cases and does not address important dissents (such as Andrews' dissent in Palsgraf), so you shouldn't attempt to rely on it for that purpose. You could easily get through torts without this book, but given the nature of law school curves, why not give yourself every advantage?

    Torts and Property are the top two E&E books in terms of how helpful they are in covering complex topics for the 1st year law student. This book's layout matches almost perfectly with most torts courses, and the essay exam practices were the most helpful for my finals. Probably the best of the E&E series.

    I bought this book in addition to other E & E books for other classes. You can definitely get by without the book, not because the book isn't helpful, since the subject matter itself is relatively easy compared to other classes. It was helpful just as a general overview of the subject and in writing outlines.

    This is THE classic hornbook for torts, and is an indispensable part of any law student's library. I still find myself referring to this one from time to time. When I was in law school the lucid and clear explanations of law, combined with copious footnoted citations, made this book a joy to own and read.

    There are a lot of general torts texts, but after eight years of practice, this one still ranks near the top.

    I used this book in law school, and continue to use it 7 years into my practice. However the pocket part is the same one I've always had -- 1988 -- I cannot find an update.

    5 out of 5 stars P&K is a classic.......2001-06-14

    I used P&K to supplement my casebook and class notes, and it guided me to an A- in torts. It's a great tool and a great read. However, it does have certain limitations: the final edition was published in the late 80s, so it does not provide much guidance on product liability, infliction of emotional distress and other emerging areas of tort law.

    P&K gives you something that year 1 of law school sorely lacks: a context for the fragments in your case book. Its treatment of Palsgraf is particularly beautiful.

    And since Prosser so strongly influenced tort law, you can be confident that you are getting good information. Some of my classmates used commercial outlines and they often worried about whether they could trust the material. No such problems with P&K; it was on the money all the time. And when there was a contradiction between P&K and my textbook, I was able to go to my professor and ask her about it. Try doing that with a commercial outline.

    P&K is not merely fine reference tool; it is a genuine work of literature. I love it, and I highly recommend it.

    5 out of 5 stars A classic text . . ........2001-05-14

    . . . and one you should probably acquire for your law library at some point; its explanations are clear and lucid, and it's probably the single most-cited work on torts apart from the Restatement (Second). However, if you're a One-L looking for a study aid, there are a couple of things you should be aware of.

    First of all, the most recent edition of this text dates from 1984. That means quite a bit of it is at least slightly out of date, and some of it is massively so (particularly in the field of products liability). For a more up-to-date hornbook, consider Dobbs. (I bought and used both.)

    Second, when your torts professor talks about "black-letter law," s/he's not talking about this hornbook or any other; s/he's usually talking about the Restatement (Second) of Torts (or, in products liability, the Restatement (Third)). As much as I like hornbooks (and I am emphatically not a fan of the "casebook" approach), I have to say that if you want to get _one_ text to supplement your casebook, you should pick up _A Concise Restatement of Torts_ from the American Law Institute. And, ideally, you should memorize large portions of it.

    Of course, you can do what I did: buy all three. It's a great investment, and it will pay off in your studies; Prosser and Keeton provide much helpful discussion of points that Dobbs treats more briefly, and the Concise Restatement is much easier to understand once you've digested the hornbook(s).

    At any rate, this _is_ a classic text and you shouldn't go without it for any longer than necessary. Just be aware of what you're buying and set your priorities accordingly.

    3 out of 5 stars A compelling story; mediocre literature.......2007-09-28

    First, I don't think this book is for everyone. I think the difference between this book and those written by someone like John Grisham illustrates the reason. Although Grisham's books are also mediocre literature, the nuances of his books aren't lost on the average reader. The things that give Grisham's books there suspense are easy for nearly everyone to understand; a book like The Firm is a case in point. Conversely, the suspense and frustrations which are inherent in "A Civil Action" are the products of rules of civil procedure which the average reader simply won't understand. For those not voiced in such legal themes at least on an elementary level the source of the suspense must be taken at the author's word.

    To be sure, the true story captured in this book is compelling; contamination of a city's water supply and the likeliness that the contamination caused a whole litany of health problems for that city's residents is a story that will do more than peak your interest. However, the guts of this book focuses mostly on the head lawyer for the victims. Jan Schlichtmann isn't exactly the type of character you find yourself rooting for (he's arrogant, greedy, and loves the spotlight). Further, this book focuses mostly on how Schlichtmann managed to screw up. The most emotion-invoking feature of the book is the ever present conflict between Schlichtmann and Judge Skinner. Again, this conflict is imbedded with underlying legal themes which makes the story not completely approachable.

    I was torn between giving this book three or four stars. For the law students out there it will probable be an enjoyable read. However, I think this book deserves three stars in the end. As popular literature it is okay; nothing to write home about. Further, in keeping with the modern style, the author presents his readers with nothing virtuous to take home with them... no idea, or principle, or thought that will inspire the readers in the course of their lives. Perhaps I shouldn't expect as much, and particularly not from a piece of popular fiction such as this. Nevertheless, there are too many other good books out there. Take this one on a plane with you; if you don't finish it by the time your trip ends don't worry about it.

    ISBN 0679772677 - A true story, A Civil Action is the story of several families in Woburn, Massachusetts, who find their children - and themselves - suffering health problems apparently caused by the dumping of chemicals by two companies. The Riley Tannery (a subsidiary of Beatrice Foods) and W.R. Grace are accused of negligently, even knowingly, contaminating the groundwater in east Woburn by dumping toxins. Young children are the first and most obvious group to become sick, dying of leukemia in numbers that defy statistics. Their case is handed off from firm to firm until it finds a home in the heart of personal injury lawyer Jan Schilchtmann.

    Told repeatedly that the case is bound to become a money-sucking wreck, Jan pours everything he's got into winning it, driving himself to bankruptcy and his law firm to the brink and beyond. As one of early the "ambulance chasers", Jan's used to settling most cases before they wind up in court, but he somehow manages to avoid every good opportunity to get out with his shirt still on. Facing off against high-priced lawyers who have very deep pockets behind them, he and his firm stand little chance of winning even a portion of what their clients want - and what they want is more apology than cash.

    Author Harr followed Schlichtmann and his team for a good portion of the story, and I felt a bit sorry for the author. It seems glaringly obvious where the fault lies (which, quite honestly, could be because of the way Harr wrote it), and the outcome seems inevitable: Grace and Beatrice will end up forking over large amounts of cash to the families and have to admit wrongdoing. When it doesn't go that way, Harr's probably too far invested in the story to put it aside. I say this because the books seems to be building to the obvious conclusion... and then sort of peters out, ending with a whimper. A fascinating, and appalling, story that really does not make a good "story" - but is so well researched and told that it rises above the strangely incomplete ending.

    Because it IS a true story, the reader should assume that there are two sides to most stories but several people come out looking like they deserve their own little corner of hell. Judge Skinner, for what seems like flagrant disinterest in the law OR common sense; Anne Anderson and the Zona family, for making it about money when they swore it wasn't and the sheer nerve of suing a guy who has taken on a case for them that no one else wanted to touch and lost everything in the process. There are others, and the case seems to be still alive in some ways, with reviewers posting strange diatribes about people who weren't even mentioned in the book (Ken Grant, for one).

    Worth reading, but the suggestion that you should read it like a novel, which I've seen in other reviews, might leave you vaguely disappointed - this is real life, and the fairytale ending that a novel would have doesn't exist.

    This copy includes a 1996 Afterword, which does help make up a little bit for the ending which, as I said, seems to just peter out.

    A Civil Action is a legal thriller born of profound human tragedy. Without a doubt, A Civil Action is compelling and sets up a good case scenario where ordinary folks are caught up between tragedy and justice. The behind-the-scene look at the law, its players, and victims revealed some sad truths about the practice of law in the face of obvious corporate wrongdoing.

    I am not a lawyer, I am not in law school, but I do have interest in the law and legal issues. I've seen the movie one or two times, but the book is WAAAAAY better. The movie is barely a summary of what the book contains.

    The story itself it quite good and kept me turning pages. I've also read the Buffalo Creek Disaster and I think this one is a little better, although I highly recommend Buffalo Creek as well.

    If you're trying to decide between Emmanuel's outline and the Gilbert one, I suggest always going with Gilbert's. The Gilbert lecture on cassette/CD is good, too.

    The Gilbert outlines seem to always seem to have better/more examples than Emmanuel's. All of the outlines are still frustrating to me. I prefer the Finals series - shorter, sweeter & lots of practice test questions.

    I think Gilbert Law Summaries: Torts is a solid commercial outline. I am glad I spent the money for it. I used the book for my first year torts class. I found the book to be useful as a review resource once I spent time reading/briefing the cases. Buy it and use it as a supplement, not a replacement for class prep and case briefing.

    This book is not just a study guide for last minute cramming. I recommend you buy it early in the semester and use it as a companion for the entire course (coming from someone who bought it in November and is kicking himself). Reading this book after you have read and briefed your casebook will give you a nice little summary of the topic you're studying. Yes there are outlines. Yes there are practice questions. But this is also a great way to prepare for each class, not just the final.

    This summary is very useful; it will increase your understanding of torts as well as your exam scores. It is organized quite well and is easy to read. The numberous charts are very helpful when time is short.

      I used the Professional Responsibility Law in a Flash Cards along with some other study aids and my score on the MPRE was 137!out of 150. This product is a very good investment. While there are many cards to go through, the cards provide a comprehensive review especially for someone like me who did not take a professional responsibility course while in law school.

      I used these cards because I was in the middle of taking Professional Responsibility and wanted to cover the things we hadn't gotten to before taking the MPRE. I started reading the cards 3 days before the test and probably spent 10-15 hours going through them.
      After reading a few cards I realized that they were also useful in refreshing the things I had already learned.
      I basically read all of the cards and pulled out ones that were new to me or that I wanted to review more. Then on the day of the test I went through the cards I had pulled out.
      The information on the cards is very clearly expressed and easy to understand. Most importantly the sample questions seem to be in the same format and approach as the MPRE questions.
      While some may find that this set is way too much information, it's easy enough to skip over sections or cards you already know or are comfortable with.
      My only (minor) complaint is that some of the party and attorney names are extremely corny and tend to distract from the actual question. But if you are prepared to roll your eyes at "Donald Chump" references, these cards are really useful.

      The MPRE doesn't take this much studying. There are like a million cards in this set. They are helpful, but I didn't have the time to get through them all before I had to take the test. If you are the type that needs to overprepare for everything, then these may be your solution. If you think that ethics isn't too tough and you just need something to refresh your memory before the exam, get something else.

      I scored 126 using this and the Strategies book. I read all the cards twice over a 4 week period and used the sample questions in the book as practice. I did not attend an American law school or take a course on professional responsibility at any time before taking the exam. I found the book good as an introduction to the style of the examination but the cards really cover all you need to pass in style.
