    Animal law is, in its simplest (and broadest) sense, a combination of statutory and decisional law in which the nature--legal, social, or biological--of non-human animals is an important factor. This new edition contains significant reorganization and updating while continuing to present a cohesive format that touches on many areas in which animals affect legal doctrines, caselaw, and legislative direction. Because animal law is not a traditional legal field, the book is largely framed according to traditional legal headings such as tort, contract, criminal, and constitutional law. Each chapter sets out cases and commentary where animal law has begun to develop its own doctrine. In this third edition, the text has been updated and several chapters reorganized and revised to provide even greater clarity and organization than in earlier editions. An important new chapter, collecting cases and commentary on the commercial use of animals, covers diverse areas including agriculture, biomedical research, and entertainment.

    As in the first two editions, animal law as presented in this book is not synonymous with "animal rights" or with any particular political, moral, or ethical agenda. Rather, it is an objective and logical specialization of a challenging area--one with a growing number of cases and statutes, increasing public and practical interest, and significantly different historical, legal, and philosophical foundations than most other areas of law.

      I highly recommend this book to anyone in the horse world. I own a small horse farm, and I have learned the hard way that you need to be very aware of equine law before you sell a horse (or board, etc). This is kind of a thin book, but it covers a lot and was easy to read. It's a small investment that may save lots of money and heartache in the long run! So no matter if you have one horse, or a hundred, you really should read this helpful little book!

      I'm not sure how I even came across this book but what a wonderful find. This book illustrates the complex relationship among the farmworkers, growers, contractors, unionists, advocates, lobbyists, etc. It was extremely well written and readable, alternating between background information/statistics and first person narratives. I also liked the photographs (which were not of the same people who spoke in the book) but would have liked informative captions to go along with them. I am astounded by the enormity of this industry and the agricultural power of the USA. I would certainly pay more for my produce if it would help improve the farmworkers' situation (although the book clearly states that consumer price has little to do with these conditions). I can no longer look at fruits and vegetables the same way.

      Read This Book! The book With These Hands, is a very accurate depiction of migrant farmworks today. The author, Daniel Rothenberg, is an anthropologist that spent three years living among workers and getting to know the people who work in the labor camps. He compiled more than 250 interviews to try and gain insight on the numerous hardships that these people face. Many people only hear about migrant workers who get into run-ins with the law, therefore giving these people a stereotypical view of how many of these migrants actually are, and what they go through to make such horrible wages. Every aspect of these farmworkers lives are explored, from wages to the farm labor market to consequences of labor practices. This book is really a reality check to people because of how much these workers have an affect on our lives. People don't stop to think about how all of their fruit products are gathered and how the workers are treated for doing such back breaking work. This book differs from many others that have been written on this same topic because it covers all different angles of migrant farmwork for yesterday and today. A definite two thumbs up!

      With These Hands is an excellent book that contains oral histories -- astonishing interviews -- with farmworkers, growers, labor contractors, government officials and labor union officials. These statements are interspersed with excellent but brief summaries of various issues. The full range of the complexity of farmworkers' lives is explored, from wages and benefits to the structure of the farm labor market to the international consequences of agricultural labor practices. As a lawyer for migrant farmworkers, I'm all for books about them but have been disappointed by a lot of what has been written. This book does not disappoint.

      "The Poorest of the Invisible Working Poor" could be an alternate title for Daniel Rothenberg's "With These Hands." Most of us know migrant farm workers only when one of them breaks the law and get written up in the newspaper. However, just about every piece of produce we routinely select at the supermarket has passed through their hands. I particularly liked the format of Rothenberg's book, alternating factual explanation with monologues by those involved in farm labor. I appreciated the wide variety of viewpoints exposed, not just those of migrant workers, but also of contractors, farmer employers, government officials and labor organizers. Most migrant farmworkers are Hispanic, many of them in this country legally, and some are U.S. citizens from years back. Many others, out of economic desperation, risk their lives sneaking across the U.S./Mexican border to find honest work doing the most backbreaking labor, under the most inhumane living conditions, for the most miserable wages. Their sheer numbers help keep farmworker wages low, but the power of the agricultural lobby has helped maintain the dismal conditions of farm labor since the Depression. Everyone who eats should read this book. Every politician should read it twice.

        Philip L. Martin examines the key features of the farm labor market in California, including the shifting ethnicity of the worker pool and the evolution of the major unions, beginning with the Wobblies. Finally, he reviews the impact of immigration on agriculture in the state.

        Today, many states look to the California experience to assess whether the ALRA can serve as a model for their own farm labor relations laws. In Martin's view, California's efforts to grant rights to farm workers so that they can help themselves have failed because of continued unauthorized migration and the changing structure of farm employment.         3 out of 5 stars A View into the Politics of the Farm Act.......2002-05-06

        This book generally looks at the political issues and concerns surrounding passage of the 1996 Farm Act. It takes the reader to developments and dealings in Congress back to 1994, giving the reader more than just floor debates or reports. Probably the best aspect to the book is that it does provide the reader with the context and concerns of both the Republicans and Democrats throughout the lengthy time the legislation was being debated. Simply put, this is background for legislative history of the Farm Act.

        What I really think this book lacked was reference to the concerns or direct input outside the political realm. The legislation was intended to restructure programatic problems within the government, in order to ultimately benefit the family farm and the wider agricultural community. And despite mention of some concerns, I felt this was mostly a discussion of politics, not farming. Just be aware of what your are buying: a book on politics, not an informative book on impact to farming.

          Today's international trade regime explicitly rejects cultural perceptions of what is safe to eat, overturning millennia of tradition. The World Trade Organization (WTO) Agreement on the Application of Sanitary and Phytosanitary Measures (SPS) enshrines "science" as the arbiter in resolving disputes involving this vital human need. This mandate, however, is under attack from many quarters. Critics cite environmental and ethical concerns, unpredictably changing technology, taste, food preferences, local culture, adequacy of governmental implementation of WTO standards, and the reliability of scientific opinion. A basic conflict has crystallized: food as culture versus food as commerce. The WTO/SPS approach is increasingly challenged for its balance in favor of economic considerations, and for its visible undermining of unique cultural identities. This important book explores the relationship between the SPS Agreement, food traditions, science, and technology. It deliberately confronts those trade experts who refuse to allow other social sciences to influence their economics-based trade theory. The author ably investigates the local perception of food and food safety from the anthropological and historical points of view, the evolution of food production technologies, and the medicinal, proscriptive (taboo) and security aspects of food that continue to prevail in nearly all cultures today. She succeeds in demonstrating that, no matter how strong the faith in science and economics, it is unwise to flagrantly dismiss the deeply rooted beliefs of billions of people, a huge majority of the world's population. The Beef Hormones case; the remaining sovereignty related to food safety measures; the increasing significance of "appropriate levels of protection" and "the precautionary principle"; the redefinition of "food hazard" to include production processes as well as food itself; genetically modified seeds and food products; the concept of "risk" in the science-based context of the Codex Alimentarius - these are among the issues and topics covered in depth. The author concludes that, although quick "legal" resolutions of trade disputes about what people should or should not eat might provide a "win" for open trade, support for the entire structure and rationale of the WTO is undermined unless (at the least) some flexibility of interpretation is introduced into the WTO Dispute Resolution System in order to recognize the weight and validity of public opinion. Food safety is arguably the most important issue affecting international commerce today, urgently demanding enlightened discussion and action based on global consensus. This well-researched and thoughtful contribution offers significant clarification and perspective to policymakers, lawyers, academics and others engaged in this critical human drama in progress on the world stage.
