very thorough.......2007-09-25
Probably the best product available. I bought the book plus CD. The book is very detailed and covers most topics you would want to know about in case you pass on. I feel I have a good understanding of the process. Estate planning is somewhat complex and takes time. You must read the book before plugging in the software so you will understand the major decisions you must make.
This package will crank out straight forward, no nonsense wills and related paperwork that is valid and binding. You do not need a lawyer. However if you have anything complicated or involves many conditions, you better pay the lawyers fees.
It's OK but won't work on Mac.......2007-09-12
I have not used all the pieces of this and it has some limitations but it is a cheap way to get a will I guess. I am mostly annoyed that they don't make it for Mac which makes it a bigger hassle for me since I am a Mac user.
Very good if your needs are basic.......2007-08-24
My wife and I bought this product before we went on an out of the country vacation and left our toddler with relatives. We wanted to have the peace of mind that our intentions were documented and known. Our situation is not complex so we found the program and documentation to be very accommodating.
I would guess that someone who had a great deal of acquired wealth and assests, or a complex family system may want to invest in an attorney's assistance.
Easy to use product........2007-08-23
WillMaker was simple to use, and didn't take much time at all. It is a great way to get your affairs in order. It's not easy to think about death, but I think it is important, so those who survive you don't have as many difficult issues around one's death.
This program also has some other useful legal programs such as childcare contracts.
Lots of Reading but Well Worth It.......2007-08-08
I didn't want to go to a lawyer and spend lots of $ on the very little money I have. The software comes with a very detailed book and explains everything very well. I did actually write my will that day and living will as well.I just have to get it signed by witnesses and notarized. I didn't give it a perfect 5 b/c there is no such thing as perfect. That's just my own opinion. Well worth the money and the software goes through the will process step by step.

Most of us know that upon our demise, a succession of fees and taxes will eat into our estates--no matter their size--if we don't plan now to protect them. Unfortunately, many of us still postpone this process because we hesitate to summon the outside legal assistance that's traditionally been required. The folks at Nolo Press have made it their mission to provide us with the means to complete a relatively uncomplicated official arrangement like this without lawyers, however, and their third edition of Make Your Own Living Trust offers hope even to the most hesitant among us. With easy-to-follow instructions, helpful worksheets, and all of the forms necessary, attorney Denis Clifford shows both individuals and couples how to avoid otherwise inevitable delays and costs by preparing on their own to transfer their property directly to their designated heirs. Clifford's method involves the creation of a "living trust," which is a basic legal entity that allows property to be simply passed along in this way immediately upon the death of the person who created it. He outlines advantages and drawbacks, and then clearly lays out the entire process. The excuses stop here. --Howard Rothman

Best resource on the subject.......2007-08-16
In order to help my parents with their trust, I had checked out about a dozen books on the subject from the library. I found Denis Clifford's to be the easiest to follow and easiest to read on a fairly complex subject. I found the book (and his "Plan Your Estate" book) so informative I bought a set for myself.
This book offers lots of "real life" examples of different types of financial scenarios and the best options for setting up a trust that will protect the assets from excessive legal fees and/or estate taxes. It covers almost everything you need to know to either write your own trust or carefully check the details of your trust if prepared by a lawyer.
The CD included provides you with the language you need to write your own by filling in the blanks, as well as the step-by-step procedure to cover all the bases to be certain the trust meets all the legal & tax requirements for trusts.
This book is also apparently updated each year, as the tax and estate laws are frequently being revised. I highly recommend this book, and also highly recommend as a companion book that covers other aspects of financial planning, wills, etc., Dennis Clifford's Plan Your Estate.
I was so impressed I also bought copies of both books for my parents and my sister so we could all get our finances in order.
Another Great Book From NOLO .......2007-05-08
Nolo Press continues the tradition of providing step by step guidance through complex legal processes. Step by step demystification of the process.
Even if you are going to use an attorney this is a good read and you will save many times the cost of the book in having answered your own questions and by receiving a good introduction to the subject.
Highly recommended
Attorney Approved.......2006-03-11
I am an attorney (shyreslaw.com) and I highly recommend this book for those who could use a simple trust and want to avoid probate. Even if you decide to hire an attorney, this book is invaluable because it offers great insight into trusts and avoiding the probate system.
Attorney Denis Clifford wrote this great do-it-yourself book which provides everyone a way to create their own simple living trust. A CD-ROM is also provided so you can easily input your information and print it out.
For a more complete estate plan, the book introduces the importance of pourover wills in case the trust fails to encompass all the property. You may want to peruse Mr. Clifford's Simple Will Book as well (another recommended buy).
Recommend highly..........2006-02-21
"Make Your Own Living Trust" was so easy to follow I recommend it to all the baby boomers. The disc attached to the back made it easy to print the required forms.
Great buy!.......2004-05-18
This book was a god-send! I was skeptical at first because I have no legal backround and I thought that making my own living trust would be complicated at best, impossible at worst. But following a recommendation of a friend I decided to give do-it-yourself law a shot. Boy am I happy I did! I saved a fortune in legal fees and was able to get the job done just as well as if I'd had a lawyer coaching me every step of the way.
Make Your Own Living Trust was easy to use and very accessible. It even has all of the forms you'll need on an enclosed CD-ROM. Thanks to this book I was able to transfer assets such as stocks, real estate and jewelry to my trust, appoint someone to manage the property that I'm leaving my children, and keep control over it while I live. So don't be afraid to do it yourself, you'll save money and get your trust done the way you want it!

Great Book By A Great Teacher.......2003-10-19
Gerry Beyer was my "Wills and Trusts" professor in law school. He was my favorite teacher, and the favorite of many of my fellow law students, for several reasons: first of all, he had an excellent command of the law. There wasn't an aspect of it he didn't know. Secondly, he taught in a clear and concise manner. Many of my law professors were "hide-the-ball" types: their clumsy use of the Socratic method left students lost and confused. When Professor Beyer lectured, you knew exactly what point he was trying to make. You didn't have to guess at it. Finally, he was a warm, friendly, humorous guy - very approachable and not at all intimidating, a rare trait in a lawyer. This book is everything Professor Beyer is: knowledgeable, approachable, and clear. And as a rookie attorney in the field of wills, trusts, and estate planning, this is the book I turn to first and foremost as a reference. That said, I believe this book is most appropriate for law students, paralegals, practicing attorneys, and others who need a serious grasp of wills, trusts, and estate planning law. Those who want a simple, cursory introduction may find themselves overwhelmed by all the legal jargon - as was mentioned by a previous reviewer.
explanatory but too much jargon.......2003-01-02
it's a good book but you should keep in hand a law dictionary.
Book Description
Shows lawyers how to manage their practices in a more business-like manner. It explains how to determine both personal and law firm goals.
Book Description
Regarded as one of the best casebooks available for any course, this comprehensive text combines interesting cases, well-tailored notes, and a clear organization into an excellent teaching tool.
The new Seventh Edition retains the late Jesse Dukeminier's unique blend of wit, erudition, insight, and playfulness and covers all the key topics in a logical, clear organization. Included are interesting cases that are not only fun to read, but fun for professors to teach as well. Cases are enhanced and connected to broader legal principles by well-written notes, questions, and problems and cartoons, illustrations, and photographs provide humorous interruptions and visual commentary at appropriate places within the text. New authors James Lindgren and Robert Sitkoff updated the book to reflect legal change while remaining careful to retain the same interesting mix of cases, engaging notes and flexible organization that makes this a highly successful casebook. Additions and improvements to the previous edition include due attention to new developments in law reform by the ALI and NCCUSL such as: Restatement Third, Trusts (2003, Uniform Trust Code (2000) including proposed 2004 amendments, Restatement (Third) of Property: Wills and Other Donative Transfers (2001, 2003)and Uniform Disclaimer of Property Interests Act (2002. Attention is given to ongoing developments in the law such as inheritance rights of posthumously conceived children, standing of donors in suits against the trustees of charitable trusts, the rise of domestic offshore self-settled spendthrift trusts, the erosion of the rule against perpetuities and the rise of the perpetual, generation-skipping trust. There is enhanced coverage of increasingly important topics such as fiduciary administration and trust investment law (including modern portfolio theory, diversification, the principal and income problem, and measuring damages; and inheritance rights of same-sex partners, inheritance rights of children, with comparison to the other common law countries (which are far more generous to children). Also included is a more logical presentation of nonprobate transfers and their role in estate planning, fully updated tax chapter with attention to new developments such as the Economic Growth and Tax Relief Reconciliation Act of 2001. Notes, questions, and problems have been revised throughout where appropriate in light of the foregoing and other developments.

Very Effective and Illustrative of the Necessary Elements.......2007-09-12
Makes the seemingly not interesting topic of Wills & Trusts come alive and you can see the real life applicability of it.
Excellent purchase.......2007-09-08
This was an excellent purchase. It is the book that I needed and it's wear was accurately depicted.
Easy reading.......2007-01-13
This is a very well wrtten text for a very complicated subject. The chapters and sections are ordered logically. First it gives you a definition, then a basic description of a rule, system or method, then it explains exceptions to the rules, THEN you read a case. I wish all of my books were written this way! It was so easy to quickly access the information and know exactly what you are suppose to be getting out of the readings. I would even recommend it as a supplement to another, less accessable textbook.
Thoughtfully written and thought provoking.......2007-01-11
Unlike other dry law school casebooks, Dukeminier captures the humanity in this study of Trusts & Estates. The editor footnotes and some of the case studies read anecdotally--giving the concepts a historical and personal dimension. The notes after the cases study the social implications of the courts' decisions. Especially interesting are Dukeminier's disucssions of the implications on the legal order caused by same-sex marriage and transgender issues. This book is thoughtfully crafted, a must read for law students or lawyers interested in this area of the law!
Don't Settle for Imitations.......2005-07-09
Whether you are the law student to whom the book is addressed, or just a savvy layman who needs to fill some gaps quickly, this book just may be all you'll ever need on wills, trusts, and estates. I ordered ten books to research my paper on inter vivos trusts and over half the footnotes reference Dukeminier. In each topical area, the general statutes are explained, often with ancillary explanations of tax treatment, then the authors dive into cases, explaining how the cases were argued and adjudicated. The text flows so well that you feel as though you are having a conversation with the authors. I particularly enjoyed the entertaining anecdotes drawn from pop culture. Do not let the cost of this book be a factor in your decision to purchase it; you may find yourself refering to it when you attend to your own will, trusts, and estate.

Customer Reviews:
Informative, helpful.......2007-06-11
This book gives you a good overview of what your Will should say. I used it as reference only. I had my lawyer revise some verbage in my will.
Comprehensive legal guide to writing any kind of will. Don't put your estate planning off........2007-04-05
Nolo Press was founded on the principle that not all legal transactions require retention of a lawyer. A valid, legal will can be drafted with the help of Nolo's Simple Will Book. You will get far more utility than the cover price of $36.99 (regularly 30% off at Amazon) would get you from a lawyer for that cost. The author is quick to point out when specific family or estate situations are too complex to be addressed by a self-help title, and he directs the reader to professional legal help in dozens of specific scenarios.
For someone who has basic property and investments to leave in their will, this book offers a number of full-in-the blank or completely customizable options for writing your will. Despite the urge to skip right to the forms, the reader should take his or her time to read through the opening chapters to familiarize his/herself with the clauses, vocabulary, witness requirements, and potential pitfalls of drafting and finalizing a will. There are dozens of tables scattered throughout the book which break down the laws in every state, showing which are community property vs. not, which recognize civil unions, which have specific legal provisions, and so on.
This book is worth every penny and no adult should be without a legal, binding will. This book will show you how to draft your will in a matter of hours and at a cost of $37.
Simple and straightforward - includes CD with forms!.......2006-10-14
This book (6th edition) has taken a BIG weight off of my mind regarding writing a will. My husband and I currently don't have a will (and apparently have lots of company - reportedly 60% of Americans don't have wills), but I am in the process of changing that with the reassuring help of this book.
Yes, you CAN write your own legal will, and it truly isn't difficult. As this book points out, even lawyers use standard forms for wills which they customize to their clients. The NOLO CD that accompanies this book also contains standard forms which you can modify, and it walks you through the different parts of a will and the various decisions you need to make. It also flags decisions/areas that you need to give particularly careful consideration. And it flags more complications situations that might or do require a lawyer (such as, wanting to give more than 50% of your estate to someone other than your spouse).
I will say that our situation isn't complicated, our "estate" basically consists of our home and some savings/investment accounts, and we have young children to provide for. I feel very confident that a will written using this book/CD will be completely legal and appropriate.
But I think this book would be quite valuable even to people planning to use a lawyer for more complicated estate planning needs, as it explains wills and their components in clear, concise terms.
Will writing is easy........2005-09-23
I bought this book mostly because I wanted my daughter in the right hands if something were to happen to both my husband and I. Peace of mind knowing that she will indeed end up with the people we select is worth a million and we didn't to have to spend much money to set this up. This book is great to have your wishes put down so everything is distributed how you want it. Much more convenient then going to a lawyer and saves you a lot of money.
mking a will made easy.......2005-07-07
This subject is presented in a logical and easy to follow way. I appreaciated that all bases were covered. I would recommend Nolo`s Simple Will Book as a good investment.

Showing a number of sample estate plans, explaining what hiring a lawyer can do for you (and how to choose a good one), how to do your own research, and including a glossary of estate-planning terms, Clifford and Jordan give you the tools to decide for yourself how you want your estate disposed of--and to make sure that's what your legal documents reflect. --Stephanie Gold

Customer Reviews:
excellent book.......2006-11-07
As a student at Yale Law School planning to go into estate planning, I found this book very helpful. Highly recommended for anyone who needs to plan their estate or for law students taking estate tax or planning courses. This book is easy to understand, well organized, and provides a good amount of detailed information, not just vague ideas. Highly recommended.
Excellent resource.......2005-09-06
This book is a must buy resource for persons interested in estate planning. Whether you are planning to do-it-yourself or use a lawyer, it is good to know what your options are. I am much better informed after reading this book.
Comprehensive Estate Planning Techniques.......2005-01-08
This book provides an easy to understand overview of estate planning plus easy to understand detail on many special circumstances. It is very easy to understand which estate planning techniques are right for you, and there are many examples that illustrate how the techniques work. Approximately half of this book is relevant to everyone. The other half gives clear, common sense explantions of advanced planning techniques that are typically reserved for those fortunate enough to be planning a high net worth estate (lets say $1M+). The advanced techniques are not for do it yourselfers, but the book gives you a good understanding of the issues and lets you converse intelligently with an attorney.
A "must-have", "do-it-yourself" legal resource.......2004-12-13
Now in a newly updated and expanded seventh edition, Plan Your Estate is a resource provided by attorneys Denis Clifford and Cora Jordan which is packed from cover to cover with everything anyone needs to know to ensure their worldly goods are promptly willed to loved ones. Written in no-nonsense terms that the non-specialist general reader can readily grasp, individual chapters clearly address wills, how to avoid probate, living trusts, property-control trusts, naming guardians for children and leaving property to children, estate taxes, living wills, how to reduce estate taxes, and much, much more. Especially recommended for individuals who own a business or who have children from a former marriage, Plan Your Estate is a "must-have", "do-it-yourself" legal resource, which is applicable to all American states except for Louisiana. Even those who prefer to let a professional handle the whole process of estate planning would be well served to read Plan Your Estate cover to cover, before stepping into an attorney's office where time is money and the clock is running.
very good study guide and book.......2004-06-15
Great for law students taking an estate planning course or an estate and gift tax course. Also good for people wanting to learn about estate planning in general. I would recommend this book.
Book Description
Do you possess great wealth, or are you working hard to accumulate it? In either case, this book is a godsend for you.
Based on her own experiences and those of her clients with the Dark Side of wealth, Thayer Willis shines a light into an area seldom thought about, let alone addressed, in our materialistic culture.
In Navigating the Dark Side of Wealth, Ms. Willis details the pitfalls that great wealth can lead people into: the morally corrupting and emotionally stunting effects that having material riches can cause, and the pain and heartache that ensue. More importantly, within these pages she provides the needed guidance that, if taken to heart, can lead troubled inheritors to more balanced and fulfilling relationships.
Customer Reviews:
Not just for the wealthy.......2007-05-19
Not just for the wealthy, Willis accurately describes the situation of young middle-class Americans born into a society of abundance. Her description of the Agression - Assertiveness - Passivity continuum and struggle we middle-classers' seem to have with entitlement was worth the book alone.
Willis case-study style makes each chapter enjoyable and easy to read.
Great For Non-Inheritors, too: Fascinating and Captivating.......2007-05-15
This book is fascinating and thought provoking! With all of the stories and case studies, it is a captivating and a very quick read. Although I am not a mega-inheritor, I could very much relate to the perspectives and suggestions made by the author. The book provides insight and compassion into the challenges of dealing with great wealth, and guidance that actually applies to anyone with any amount of money. There is so much sound advice in this book, that I think if the author re-titled it as "Navigating the Dark Side of Money", and removed the references to large sums of wealth, it could easily become a best-seller for the main-stream, moderate-income population! The author is geniune and honest about the importance of Christianity in her life, yet - as a non-Christian - I did not find it overbearing or at all inappropriate. Her commentary on spirituality is inclusive and I think would be well-received by anyone of any religion or spiritual practice. She even inspired me to look up the few Biblical references she made to add insight to her views!
Very helpful to show some of the struggles of wealthy.......2007-01-09
I read this book as part of my ongoing research on money and psychology. I found the author's story to be helpful in understanding the problems of meaninglessness, addiction and loneliness that sometimes come with wealth. Are there families who handle wealth well and give their children the character strength and knowledge they will need to manage the energy of money? Yes of course there are..they are not the ones having the problems. This book is really a good resource for those who are having struggles similar to Thayer Willis...to help them see some of the dynamics of the family and the dynamics of wealth that need to be managed.A good contribution to the field.Dr. Mary Gresham
Opportunities for Young or Old Inheritors.......2006-01-30
Excellent book for individuals, who have inherited money or have accumulated a large amount of wealth at any early age and retired. Gives examples of opportunities for enriching ones life and providing knowledge of how to maintain wealth for future generations.
An Important Book for the Right Reasons.......2003-10-02
Navigating the Dark Side of Wealth is an extremely valuable book for all the right reasons, because its focus is not on accumulating and multiplying material riches but on fostering the emotional and spiritual values so vital to coping with the destructive allurements, issues and challenges that confront many inheritors of material wealth today. It is a text on developing character and morality -- on protecting one's soul against the pervasive ravages of human greed.
