Book Description
This anthology of classical and contemporary philosophical and legal essays and legal cases focuses on legal philosophy as its own subject–rather than as an outgrowth of social or political philosophy or applied ethics. The essays focus on how law is organized and the particular philosophical issues that law raises. The book requires readers to think through actual debates–many of them still live in the courts. Initial sections on legal practice, legal reasoning, and the nature of law are followed by discussions of criminal, tort, contract, property and constitutional law. Also includes strong religious freedom and equality and the constitution coverage. For lawyers or philosophers studying legal philosophy.

Readings in the Philosophy of Law
Manufacturer: Broadview Press ProductGroup: Book Binding: Paperback Similar Items: ASIN: 1551111799 |
Book Description
"Keith Culver's 'Readings in the Philosophy of Law' provides a thorough introduction to the central issues without burden of a near encyclopedic tome. The reward is an ideally constituted anthology, the contents of which speak to each other and expose the living, dynamic world of philosophy of law. In the first section, Culver offers four divergent and competing responses to the question 'What is law?' Their arrangement effectively highlights their similarities and differences, as well as the strengths and weaknesses of each approach. In the second section, Culver examines what the relationship between law and individual liberty ought to be. Here, Culver includes the Hart-Devlin debate on the legality of homosexuality and the problem of legal moralism. The third section addresses the problem of legal responsibility (Culver accentuates the readings with the somewhat controversial case, R v Shivpuri, in which the British House of Lords reversed itself on the question of whether criminal intent, in the absence of criminal action, is sufficient to generate criminal responsibility). The fourth section, on international law, demonstrates an extremely appealing aspect of the text. Other books often emphasize specific legal cultures and give the mistaken impression that to study law means to study the laws and legal system of a given nation. While Culver draws on material from the common law tradition, the readings are combined in such a way as to underscore the central characteristics of law regardless of the national, political, or moral contexts in which particular legal systems arise. Culver has a good eye for cases that best highlight the theoretical discussions and exemplify the sometimes controversial influence of legal theory on judicial practice. Each section is supplemented with a list of questions and readings designed to orient discussion around the central themes. Culver also includes a glossary of legal and philosophic terms that will prove helpful to readers newly exposed to philosophy and the study of law. Culver's text is an accomplished introduction to the philosophy of law. Of ideal length, uncommon quality, timely and relevant content, 'Readings in the Philosophy of Law' will prove a valuable resource for instructors, students, and general readers alike." Christina M. The Responsible Judge: Readings in Judicial Ethics
Manufacturer: Praeger Paperback ProductGroup: Book Binding: Paperback ASIN: 0275940233 |
Book Description
Society and individual members thereof who approach the court in conscience desire justice. They place their hope not only in the knowledge but also in the morality of the judges. At a time when the values of the judiciary are under intense scrutiny, Noonan and Winston present an extensive, highly informed collection of readings with commentary and explication. They address the concept and role of "judge," the act of "judging," and the requirements and potential abuses inherent in the system and process of sitting in judgment. This is a reflective, yet eminently realistic consideration of the fundamental issues and questions involved in establishing a reasonable framework for assessing judicial morality. The work first examines qualities of the ideal, corrupt, and over-zealous or political judge. The editors next address the judge's role and response in view of the tensions rising not only from the facts of the case and legal precedents but also from such human qualities as compassion. They also look at the power of social expectations and personal beliefs as possible influences on judicial decisions. Finally, the editors consider the need judges have for independence and study that necessary factor in relationships to accountability and also potential for abuse. This is a learned, inclusive, yet accessible and captivating, work. It will clarify and reinvigorate discussion of critically important issues fundamental to an ethical judiciary.
