Thank goodness I did not purchase this book! The library saves me again. A worthless read that did nothing to educate me in investing in probate real estate. The author focuses on anecdotal stories, mostly of success with making money off personal property--not real estate.

I concur with everyone here. after reading this nonsense i wondered who i felt more sorry for, me for the hours of life i will never get back, or for the trees that died to publish it. I agree with the previous post, look at the death records and then work backwards. And that didnt waste your time or kill any nature.
Not worth it........2006-04-29
This book does not give solid practical advice. If you're a new investor who has never bought a house before, perhaps this would work for you. But if you've bought and fixed up a property it isn't for you. You'd be better served going to the probate court in your area and asking questions. It included lots of general anecdotes, but it makes one wonder why he wrote it if he weren't truly going to share how to do it. The actual probate advice in this book could be condensed to a 10-page pamphlet.

I too had high expectations of this book. What a let down. I read alot of real estate books and this is the first time I felt cheated by the author. I thought this was a step by step book on how to purchase probate properties but I was dead wrong. Save your money, we all can't be wrong about this book...

Rarely do I write book reviews but this one was so bad that I feel obligated to let people know about it. The bottom line is that this book lacks the detail needed to really teach a person about the probate system and how to use it to successfully invest in real estate.

I'm glad I bought this book!.......2000-09-13
I will probably be asked in the next few years to be an executor, but, as is mentioned in this book's introduction, "You know generally that an executor is someone who handles the affairs of a deceased person, but you have no idea how to get the job done." After reading this book, you know that the first thing to do after the funeral is to hire an estate attorney to tell you what must be done. The book also mentions that it might be possible to totally avoid probate, which could greatly simplify things and save money. This book stresses that there is no need to try to be a do-it-yourself executor. You're definitely going to consult with a lawyer to see what the current estate laws are in your area, and you might need to also hire other professionals, but these people should all remain hired hands; the executor must stay in command. I didn't expect this book to give the estate-law quirks for all fifty states; you might find that some of what it says doesn't apply in your state. It's still a very good introduction to being an executor, and it let me know that an executor doesn't have to be totally helpless in legal land. That in itself is worth the book's cost!
One Of The Best.......2000-05-19
I have read six different books concerning wills, probate, and trusts in the past few months. Of the books that I have read, this is clearly the best. All of the standard stuff is here - except the constant reminders by the authors to hire an attorney. Unlike nearly all the other books, the authors do not talk-down to readers. The language was never too simple-minded and only in a few cases did I have to read a paragraph again to determine its meaning. The authors give hints and insights which I did not find in the other books. And the book contains the best explanation I have read concerning why trying to determine and report the lowest possible value of estate assets is not always the best idea. I do not plan to die for several years. If I could give to my future executor only one book, this would be it. I miss only estate/probate information about each state. Therefore, I am still confused about the interrelationship between state estate reporting and taxes and federal ones. Essentially, everything depends on the value of the taxable estate. If 20% of the readers of this book do so in anticipation of a death, my bet is that only 1% of those will have a taxable estate over $1 million. And those people not having a million-dollar estate (after 2006) will not need to pay federal estate taxes - thereby eliminating the need for most of the book. First-time executors reading the book because of immediate need and suspecting a taxable estate value more than $675,000 will be able to afford to hire a lawyer to do the (subjectively) most difficult parts of the job.
Good, But!.......2000-04-12
As an overview, it's difficult to imagine a better introduction to the labyrinthine ways of settling an estate. But as to details and particulars, it's woefully inadequate. The checklist at the end of the book is helpful. The thesis, viz., KEEP RECORDS, is important. But it's examples and suggestions on how to do certain, e.g., tangible acts, like dealing with creditors, secured versus unsecured claims, goes unmentioned. despite its enormous importance. There's only two sample letters, and they're not altogether novel or esoteric. Again, a good overview, just very short on particular issues, examples, and samples.
Tells you what you need to know.......1999-09-02
This book tells you nearly everything you need to know as an executor of an estate. It has lots of detailed information and practical advice. It is far superior (and cheaper, too!) than its competitor, ``Where There's a Will'' by Bauers. The information density is very high and the explanations are clear. Note particularly the detailed advice and description of a central task, filling out the Form 706 estate tax return (though the authors do suggest you also talk to a tax attorney).
There was only one question I wish the authors had answered: how to handle the affairs of the estate between the time of death and the time one has the letters testamentary that authorize you to act as executor. In that period, it seems, you have little or no legal authority to do anything even though there is much to be done.

The best basic "how-to" guide I've seen for executors and administrators. Not "do-it-yourself" tear-out forms, just good, practical, up-to-date (in '98) advice. I'm sending complimentary copies to my executor and trustee clients (via Amazon.com, natch!)

We've all heard Suuze say "Everyone needs a Trust." This book tells how the Attorney, Trust Officer, and others establishing a trust for children abused their fiduciay duties and used their influence to create a lifetime job for themselves, one from which it may be impossible to fire them and how they take advantage of the children to feather their own nest. This is a great introduction to ethical wills. They sound really mysterious but it's a great concept -- writing a letter to the future -- that's a really valuable gift for a family. And it's a really useful process for the writer. It can give you a whole different perspective on how valuable your experiences are.

Ethical Wills by Barry Baines, MD breaks new ground in the ethical will movement within the US. Written for easy comprehension, this book covers the topic in excellent fashion, while providing the inspiration so essential to completing the task of putting our values in print for those we leave behind. The BEST book on probate in California.......2007-03-04
If you can only purchase one book on probate in California, this book should be your first stop. I am in the process of probating my mother's estate and I will save at least $20,000 by using this book. There a dozens of forms, tips and tons of information on the subject. If you are motivated and organzed, this is the guide to help you avoid the high cost of attorneys in probate. I cannot urge you STRONGLY enough to use this book as your guide to probate in California.

After my mother passed away and I was named executor, I discovered something: California's probate system is a massive, elaborate joke designed to make lawyers rich. It's incomprehensible how convoluted the process is, and how absolutely ZERO help is available. (The court clerks I turned to answered every question with this: "I can't tell you! I'm not a judge!" And, of course, it's not like you can contact a judge.) Imagine trying to file the tax returns for Microsoft without any training or instructions: that's just a hint of what you're in for here.
Armed with this book, though, I got through the process. And -- against all odds, and despite the ridiculous restrictions and obfuscations this laughable legal system imposes on people WHOSE PARENTS JUST DIED -- I got all the way through probate, saving something like $10,000 in legal fees.
So, if your estate doesn't have much money -- or the legal system just bugs the heck out of you, and you refuse to fling hard-earned money at those charlatans -- get this book and thank your lucky stars it exists.
Excellent Advice on Probating an Estate.......2005-10-14
My brother and I are in the process of probating my Mom's estate with the assistance of this excellent book by Nissley. It hops around a little bit, but all the information is between the covers. So far we have had zero problems. We have not had to consult with an attorney nor a paralegal to have our forms filed with the court. This book is going to save us time and money - about $5,000 on my Mom's small estate. Thank you Julia Nissley and Nolo Press!

I am a big fan of Nolo Press books because they are easy to understand and follow. This book was no different. It takes you step by step and even takes you through each form. It is a great book. I must have for any one who needs to probate a small estate in California.
