The Innocents is a book of portraits of former inmates accompanying a traveling exhibit by the same name mounted by the Innocence Project, a 10-year-old civil rights program founded by rock-star attorneys Peter Neufeld and Barry Scheck to free the wrongly convicted via DNA testing. Neufeld and Scheck provide the book's foreward and brief commentary on each case. The subjects are all ex-cons who were exonerated through DNA testing and then released after serving time. Some had been sentenced to life, some to death. Taryn Simon's photographs put prisoners in the spotlight--only this time they regain their dignity and become art in the process. Of the 80-plus portraits in the book, most were taken at the scenes of the crimes. Some pose with the victims. Ronald Cotton, for example, served more than 10 years of a life sentence for rape. He is photographed with a victim, both of them staring at the camera with fortitude and bitterness. Nearly every picture is similar, the subject staring directly into the lens, always surrounded by the same eerie, diffused light like the kind when tornadoes loom. The subjects are interviewed by Simon as well; their commentary is also distressing and poignant. Neil Miller says he had a better life in prison. Richard Danziger was freed but rendered brain damaged by a jailhouse attacker. Walter Snyder went to prison instead of the Olympics. Most of these subjects were convicted on the basis of witness misidentification. Simon's photos are also like mug shots, depicting their subjects with emotionless expressions and using lighting that flattens out the surroundings. But here they set the record straight as Simon's art helps re-humanize them. --Eric Reyes

Simon photographed these innocents at sites of particular significance to their illegitimate conviction: the scene of the crime, misidentification, arrest, or alibi. Jerry Layne Rogers, Sr. -- wrongfully convicted and innocent. From 1989 - 1992, I was his investigator at CCR.

Mr. Rogers' case consisted in 1992 of at least 80 boxes of documents, from court files, prosecutor and law enforcement files, trial and evidentiary hearing transcripts, etc. Mr. Rogers's case was the largest and most complicated that CCR [The Office of Capital Collateral Representative -- a state agency in the judicial branch of Florida government] has ever represented that I am aware of.

The second largest and most complicated was that of Mr. Gerald Stano, whose lead attorney during most of the development of his case was Mark E. Olive.

In 1995, Mr. Rogers began receiving pro bono representation from the Washington, D.C. law firm Covington and Burling. The result was an unanimous Florida Supreme Court (FSC) 26 page opinion ordering a new trial in Mr. Rogers' case due primarily to prosecutorial misconduct, in particular Brady v. Maryland violations.

During the summer of 2002, Mr. Rogers was re-convicted, however sentenced to life upon the jury recommendation. Now twice Mr. Rogers has been wrongfully convicted.

In 2004, the Florida 5th District Court of Appeal denied relief. The FSC declined to accept jurisdiction and thus denied the petition for review.

Mr. Rogers' case is pending Federal review.

There are emerging artists whose work tends to emphasize style over substance, of which there are many (Notable examples include Williamsburg, Brooklyn, NY artist Anissa Mack, perhaps best known for her performance piece "Pies for a Passerby" and most, though not all, of the emerging artists represented in the recent Brooklyn Museum exhibition "Open House: Working in Brooklyn".). And then there are those who can produce stylishly beautiful work, and make profound statements about culture, society, etc. through their art. Fellow Brunonian Taryn Simon - she studied photography primarily at the Rhode Island School of Design, widely regarded as America's premier art school, while still an undergraduate at Brown - is unquestionably one of these, with a distinctive documentary style which harkens back to Walker Evans's sympathetic black and white photographic portrayals of people in Depression-era America. However, here Simon has worked deliberately in color, using the conventions of commercial fashion photography to create memorable images. Hers is a splendid, mature body of work, replete with much empathy for her subjects; former convicts who were falsely accused and convicted. Each photograph is accompanied with commentary from the two attorneys in charge of the Innocence Project, Barry Scheck and Peter Neufeld. Through their Innocence Project, attorneys Scheck and Neufeld have freed scores of people who were wrongly convicted. Simon received a Guggenheim Fellowship in Photography for this project; an award normally given to artists who are in mid-career or further along, not to an emerging artist. Simon's work has been exhibited at New York City's International Center of Photography and P. S. 1 Contemporary Art Center; an international tour of these photographs had its first stop at P. S. 1. As both a fellow alumnus of her college and a fellow photographer, I eagerly look forward to yet another impressive body of work from Ms. Simon.

A Human Face on the flaws of our system.......2003-12-15

"The Innocents" is a jarring photo documentation of the issues raised by the scores of false convictions which have been overturned, primarily as a result of DNA evidence. As with Barry Scheck's book, "Actual Innocence", one of the most disturbing conclusions is that there are many more falsely-convicted individuals who never will be cleared because their alleged crimes did not leave DNA evidence behind.

The pictures in this book put a human face to the exonerated. The simple, direct accompanying text and quotes from the former prisoners tell the story over and over. I highly recommend this book in conjunction with Actual Innocence which discusses the causes of false convictions and attempts to articulate solutions to this ongoing problem with our legal system (even though it is one of the best legal systems in the world).

Too much time spent on background of the players and their attempts to legitimize their theories. Were they just trying to make the book impressive by making it longer? I think there is enough current information out there to provide a much more interesting and informative read.

An Exercise in Tuning Justice.......2005-04-17

Combining humor, history and the upheaval from DNA-proved wrongful convictions, Doyle stunningly recounts the long, bumpy process of fine-tuning justice in the American criminal system. While focused on the history and frailties of eye witness identification, this book is for anyone evenly remotely connected to ... or interested in ... the criminal justice system: psychologists, lawyers, law enforcement, pre & post conviction professionals, judges, criminologists, forensic specialists and, especially, university personnel and students of these fields. Laugh aloud when you read about Mr. Potato Head. Cringe with Jennifer Thompson as she realizes that her honest but mistaken testimony sent an innocent man to jail. Worry whether Texas executed an innocent man, a man whose last words were "they are murdering me..." This is great reading. Doyle unveils his subject with care, drawing on his uncanny ability to observe and participate simultaneously. As Doyle acknowledges in his final remarks, the science of justice does not stand still. But Doyle has made a massive contribution to describing the process, and capturing one of those rare moments when the science lurches forward. You will enjoy this book.

Doyle's story might be the "body armor" for eye witness identification. Science has produced highly effective and reasonably accessible materials to keep you safer on the street. Yet it does no good when you leave it in the trunk of your cruiser. Science has done the same for eye witness identification yet many have yet to unpack it from its box.

Read Doyle's story and decide for yourself if you are being fair to your eye witness identifications or if you are just doing it "the way it's always been done around here."

If you found new ammunition for your duty pistol that improved the accuracy of every round fired by at least 50%, would you continue to carry the same old duty ammo?

When life-saving resources are at your disposal, don't leave them in the trunk.

Well-written, thought-provoking and entertaining.......2005-02-16

I am interning as an Investigator for the Washington, DC Public Defender Service and thought I'd read this book to understand why some believe eyewitness testimony to be imperfect. So far, from 4 weeks on the job, the questions that the author puts forward in True Witness are dead-on. Even well-intentioned people make mistakes, and human memory is no camera. This book is full of examples that illustrate the author's main arguments, and it provides a nice balance of these true-life stories and a delving into the questions that the examples raise about the American legal system. I genuinely enjoyed the read, and learned a lot.

Well, Maybe I'm Not So Sure................2005-02-02

A wonderful book for members of the legal community as well as those who are intrigued and at times appalled by the criminal justice system. By using real cases, the author immediately engages the reader in a search to provide answers to the question of how well-intentioned and confident eyewitneses can be so wrong. Building on extensive historical research and documentation the author provides a fascinating look into how different disciplines (law and psychology) can work at cross purposes to achieve a common goal.

I would make it "assigned reading".

Once again, stalwart Free Press comes through with another incredibly in-depth, in fact slightly overlong, inquiry into recent history. In fact, given the subtance of the investigation, and its current limbo, this isn't really history at all, but reather current events of the most pressing nature. Who was it said that reading such and such a book was like holding lightning in your hands? Reading this book is like reading human blood.

Dr. Shaler gives us a no hold barred accout of what it was like trying to deal with the innumerable scraps of human remains found at the site of the Weorld Trade Center disaster on September 11, 2001, in New York, and in the days, weeks and even months afterwards. Scientists and doctors, some who had never spoken to each other before, strangers, and some who were outright enemies, found themselves standing shoulder to shoulder trying to use forensics to fight back, fight against prejudice, fight against violence and terror and fight against the cloud of uncertainty by trying to match easch scrap, be it of brain or liver, with an actual human being believed to have died in the attacks.

He even describes the chill with which his team came to understand that, even among the morass of human material, some of these body parts were probably those of the hijackers as well.

It's not all high science either. Dr. Shaler has the vocabulary of an average New Yorker, and he is given to a descriptive obscenity when the drama of his story calls for it. '"Don't tell me we f--ked up the identification!" I said' is a typical comeback from him. But in general, the science is paramount and it helps us understand the complexity of the work involved. By and by the forensics scientists found themselves invited to the funerals of the vitims they had matched, through DNA or otherwise. The families were grateful. There must be a primitive urge to want to preserve the scraps of your own loved one's bodies, even miniscule ones, for there were funerals for mere fingers. Reminds me of the the way Catholic churches in my youth were erected around mere "relics" embedded in the tabernacles. Dr. Shaler's writing is simple and moving on such occasions, as though Hemingway had willed his genes to a top scientist and bureaucrat:

"We stood around the grave site and waited. Soon, the bagpipers began playing and there was a short ceremony. The sun was shining and it was warm. I felt like I belonged."

This book is a factual first hand account of Dr. Shaler's experience. The book contains detailed descriptions of the complete identification process from 911. I did enjoy learning about forensics. It also made me very proud to learn how the people in government handled this situation.
The book includes the feelings and emotions from the long term commitment to assist with the critical identification process.

Forensic DNA analysis was first introduced to the American criminal justice system in the mid-1980s. In spite of its relatively brief existence in American jurisprudence, DNA testing has become the leading forensic tool for obtaining sexual assault criminal convictions, and the single most powerful evidence for establishing the innocence of criminal suspects and wrongfully convicted defendants.

The development of DNA "fingerprinting" and the role it has played in the American criminal justice system is covered in this encyclopedia. Numerous entries explain the relationship of forensic DNA analysis with microbiology, population genetics, statistics, and the legal rules of the admissibility of scientific evidence. The encyclopedia also presents the full text, preceded by summaries, of all state and federal government statutes that address the forensic use of DNA analysis, and the edited text of judicial case opinions that address specific forensic DNA issues. Also included are entries on many of the organizations that use DNA fingerprinting to free wrongly convicted defendants and many of the individuals who were released from prison (many of whom were on death row) after DNA testing proved their innocence.

DNA evidence is a powerful forensic tool in criminal cases. Its use and capabilities have increased substantially since it was first introduced in the late 1980s. A DNA profile may provide powerful evidence in many criminal investigations, either to incriminate or exculpate a suspect. DNA evidence is very stable and can be extracted and profiled from a sample many years after being deposited. The technologies used are increasingly sensitive, powerful, fast, and cost-effective. The cost of performing analyses and the time required continue to decline. Those features of the technology are likely to continue to improve over the next decade.
